More than 75,000 individuals have already lost their Internet domain names registered through RegisterFly.com, and a new class action lawsuit seeks to protect up to a million more from the same fate.
U.S. District Court judge unsealed a class action lawsuit against Internet domain registrar RegisterFly along with the corporation charged with accreditation and oversight of registrars, the Internet Corporation for Assigned Names and Numbers ("ICANN"), among others. The lawsuit alleges that RegisterFly has systematically defrauded its customers who attempted to register or renew Internet domain names, causing them to lose their domain names, finances, and even entire businesses. The lawsuit was initially sealed due to fears of retribution by RegisterFly.com towards the plaintiff for filing the suit, but since then other concerns have become more pressing, and the case was opened to the public. The Lead Plaintiff fears that RegisterFly is likely to cause the loss of her website GoCertify.com, which is the primary source of support for her and her children. The GoCertify.com domain, which had a scheduled expiration date of March 18, 2007, according to Registerfly, could not be renewed (even though plaintiff was charged for the service of having that done), was refused transfer to a different registrar, and has had ownership information completely removed or concealed from public databases as well as made inaccessible. It was clear that RegisterFly was in trouble, and the accreditation agency of registrars, ICANN, knew it, but ICANN did not perform its duty to protect the public and continued to accredit RegisterFly and allow it to perform as a registrar. In fact, ICANN, which collects a fee for every domain sold through its accredited registrars, did not give notice of termination of ICANN's accreditation of RegisterFly until ICANN was served with this class action lawsuit. The lawsuit seeks to represent any website ownerthat was unable to renew the website through RegisterFly.com

Other Technology Cases of Interest Micron Technology faces another class action lawsuit tied to alleged involvement in an supposed price-fixing scheme among memory chip makers between February 2001 and February 2003. The class action, which is the third of its kind involving price fixing, was filed on behalf of Micron shareholders in U.S. District Court in Idaho against Micron and certain of its officers and directors. The complaint alleges that Micron was engaged in a scheme to manipulate the price of DRAM between Feb. 24, 2001 and Feb. 13, 2003. On September 11, 2003, the jury ruled against the plaintiffs in a class action filed against computer giant Hewlett-Packard Company on behalf of North Carolinians who purchased certain HP DeskJet, OfficeJet, or Photosmart printers between August 1, 1998, and November 30, 2000. The action alleged that HP did not disclose to consumers that the ink cartridges that accompanied the printers were only filled to half of their total capacity. Unless the plaintiffs appeal, this ends the case. The parties have reached a tentative $3.8+ million settlement in an action filed against AT&T Corporation on behalf of certain persons who own or owned land in Ohio between January 1990 and January 8, 2003, through which railroads run and on which AT&T laid fiber optic cable. The action alleged that the company laid the cable without proper permission, in violation of state and federal property laws. Claims must be received by October 30, 2003, to be considered valid. On September 15, 2005, the parties reached a tentative settlement in several class actions that had been filed against wireless interactive entertainment provider KongZhong Corporation (Nasdaq:KONG) and certain of its officers and directors by stockholders who purchased the company's American Depositary Shares between July 9, 2004, and August 17, 2004. The actions claimed that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. A class action has been filed against AOL Time Warner subsidiary America Online, Inc. and its customer service company ICT Group, Inc. on behalf of consumers who allege that over the past four years AOL has regularly double-billed its subscribers by creating what it refers to as "spin-off sub accounts" in violation of federal law. The action seeks compensatory damages for unjust enrichment and breach of contract, plus an order that will prohibit the companies from continuing their allegedly unfair practices. Several class actions have been filed against human genome mining company deCODE genetics, Inc. (Nasdaq:DCGN) and certain of its officers and directors by stockholders who purchased the company's common stock between October 29, 2003, and August 26, 2004. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. |
