On line and in stores, mail-in-rebates have taken hold, and advertisements declaring discounts "after mail-in-rebate" are seen everywhere.
The mail-in-rebate process is supposed to be simple: (1) you buy an item, (2) you fill out and mail in the rebate forms and other documents, and (3) a portion of the sales price is returned to you. Unfortunately, in many cases, the check returning a portion of the sales price to you never arrives, even though you have correctly filled-out and mailed-in the rebate form. Part of the problem with mail-in-rebates exists because there are companies which specialize in handling rebates for manufacturers. These "rebate companies" promise manufacturers that when handling the rebates, they will keep the number of rebates which must be paid very low. To achieve their goal of keeping the number of rebates that must be honored very low, "rebate companies" may sometimes deny valid rebate submissions. Home Depot faces a class-action complaint in Palm Beach Federal Court accusing it of overcharging customers for carpet installations by estimating the amount of old carpet to be removed and installed rather than measuring it. Matthew Enderlin, an Arkansas resident, filed a class action lawsuit against XM Satellite Radio, claiming that the company's marketing of its music channels as completely commercial free is "false, misleading and deceptive." The lawsuit, filed in the Eastern District of Arkansas, seeks punitive damages and to prohibit the D.C. company from advertising and selling "commercial-free" products.
