Noisy Land Rover Sparks Class Action Suit

A class action lawsuit was filed against LandRover for their Land Rover LR3 Model. The lawsuit alleges the vehicle puts out a loud noise that is caused by uneven tire wear.

Dozens of similar complaints about uneven tire wear on the vehicle populate a forum on a popular car website. Lew Colon, the plaintiff, first noticed the situation after driving just 5,000 miles on his new 2005 model. The company declined to help him immediately, but eventually agreed to buy him three new tires. Colon would have to pay for one.

But 6,000 miles later, he noticed the same pattern on his new tire.

Colon states "In the tread design you can truly see it was wearing -- every other one was wearing."

Colon again complained to Land Rover, but 25,000 miles have passed. The company so far hasn't offered to replace the second set. Land Rover did however issue a technical service bulletin acknowledging concerns about uneven tire wear. The company's suggested fix -- readjust the alignment to new settings. But Land Rover has so far not issued a recall -- saying "it hasn't been confirmed that there is a larger concern."

Attorneys filed the class action suit on behalf of Colon and all other 2004 and 2005 LR3 owners in California covered by the technical service bulletin.

The attorney handling the case states "these vehicles are covered by the Land Rover factory warranty and when the problem is a defect in the vehicle, they're obligated to take care of the problem and pay for the repairs."

The lawsuit seeks to represent all 2004 and 2005 LR3 owners in California covered by the technical service bulletin.

Does your GM vehicle make excessive engine noise? Several class actions have been filed against General Motors Corporation on behalf of purchasers of 1999 through 2003 model GM vehicles with a 3.1, 3.4, 4.8, 5.3, 5.7 (LS1), 6.0, or 8.1 liter engine that exhibits a loud noise due to piston slap, who allege that GM actively concealed the engine defect while continuing to advertise, market, and warrant that GM engines are free from defects. Some of the models that may have the defect are the Chevrolet Camaro, Corvette, Silverado, Tahoe and Surburban; GM Denali and Yukon; Cadillac Escalade and Pontiac TransAm.
 
The theory of diminished value asserts that buyers choosing between two otherwise equal vehicles will select one that has not been previously damaged and repaired, even where the repairs to the other vehicle were first-rate. The parties have reached a tentative $1.725 million settlement in an action filed against Southern General Insurance Company on behalf all persons insured under an automobile insurance policy issued in Georgia by the company who made a claim for damage to their vehicle under their collision or comprehensive coverage for a loss that occurred between June 12, 1997, and February 13, 2002, or under their uninsured motorist coverage for a loss that occurred between June 12, 1999, and February 13, 2002. Though there is no claims deadline at this time, persons eligible to take part in the settlement who have not received a notification letter should act as soon as possible to alert the company of their eligibility.
 
Florida's laws protect consumers from businesses that would otherwise harm them. The parties have reached a tentative $6.9 million settlement in an action filed against automobile retailer AutoNation, Inc. on behalf of Floridians who allege that, from August 6, 1995, through October 31, 2000, the company failed to deliver correctly signed retail installment contracts in connection with the sale of new and used motor vehicles in violation of Florida's Motor Vehicle Retail Sales Finance and Deceptive and Unfair Trade Practices Acts. To recover under the settlement, you must submit a claim form no later than July 29, 2003.
 
Uninsured/underinsured motorist automobile insurance covers you if you are injured in an accident by a liable party who carries insufficient (or no) liability insurance. The parties have reached a tentative $2 million settlement in an action filed against Nationwide Mutual Fire Insurance Company and related companies on behalf of California policyholders who were sent a selection/rejection form by the company and had their uninsured motorist coverage limits raised unilaterally by the company above $30,000/$60,000 and paid for the coverage between January 1, 1994, and December 31, 2002. Claim forms must be postmarked by October 22, 2003, to be considered valid.
