Concentra Settles Class Action Lawsuit in Louisiana

Concentra announced that one of its wholly owned subsidiaries, FOCUS Healthcare Management, Inc., has tentatively settled a class action lawsuit in Louisiana.

The case, Gunderson, et al. v. F.A. Richard & Associates, Inc., et al., has been pending since 2004 in the state court of Louisiana, Parish of Calcasieu. The company, along with other preferred provider organizations (PPOs), insurance companies and third-party administrators, had been sued by four Louisiana health care providers alleging that the defendants provided legally insufficient notice under Louisiana law of PPO discounts to which the health care providers had contractually agreed. Similar cases were also filed against insurance carriers, PPOs and third-party administrators in the state court trial system and the workers compensation court system.

In the settlement, FOCUS has agreed to create a $12 million settlement fund and to pay an additional $250,000 to cover actual expenses related to the administration of the settlement of the class action. The parties to the class action have mutually agreed that the settlement represents a compromise of disputed claims and is not an admission of liability for any purposes. The settlement remains subject to final court approval, following notice to class members.

Other Insurance Cases of Interest

The parties have reached a tentative $3.25 million settlement in several actions filed against John Alden Financial Corporation and certain of its officers and directors by stockholders who purchased the company's common stock between October 20, 1994, and May 3, 1995. Persons eligible to participate in the settlement must file a proof of claim postmarked no later than May 16, 2004.

A class action has been filed against Wal-Mart Stores, Inc. on behalf of widows of former New Hampshire Wal-Mart employees who allege that the company purchased life insurance policies on more than a thousand employees without their knowledge in violation of their right to privacy and in breach of the company's fiduciary duties to its employees.
 
A nationwide class action has been filed against Allstate Insurance Company alleging that Allstate's policy of using credit scores as a tool for determining automotive and homeowner insurance policy premiums is discriminatory and violates the civil rights of minority policyholders.
 
The theory of diminished value asserts that buyers choosing between two otherwise equal vehicles will select one that has not been previously damaged and repaired, even where the repairs to the other vehicle were first-rate. On July 10, 2003, the court gave final approval to a settlement, apparently valued at $825,000, in a class action on behalf all persons insured by an automobile insurance policy issued in Georgia by American Manufacturers Mutual Insurance Company, American Protection Insurance Company, or Lumbermen's Mutual Casualty Company and who made a claim for damage to their vehicles under their collision, comprehensive or uninsured motorist coverage over a specified time period. Though there is no claims deadline at this time, persons who are eligible to take part in the settlement who have not received a notification letter should act as soon as possible to alert the company of their eligibility.
 
A class action lawsuit has been filed in the District Court of Maryland against Noel Bragg for violations of the Employee Retirement Income Security Act (ERISA). ERISA is a federal law that sets minimum standards for most voluntarily established pension and health plans in private industry to provide protection for individuals in these plans. Class members seek to enjoin defendants to either rescind the 2002 amendment or not apply the amendment, attorney's fees and costs of the litigation.
 
A class action lawsuit has been filed in the Middle District Court of Florida against Mayo Clinic Jacksonville for violations of Florida's Uniform Deceptive Trade Practices Act. Class members seek monetary damages, injunctive and equitable relief, attorney's fees and costs of the litigation.
