Elder Care Provider Faces Class Action Lawsuit

A class action lawsuit has been filed against elder care provider Sunwest Management for alleged deficiencies and failure to comply with state law.

The suit was filed Wednesday in Orange County Superior Court on behalf of Sophie Bury and all California citizens who resided in, or are residing in, a California Sunwest facility between Jan. 15, 2003 and Jan. 15, 2007.

According to an attorney handling the lawsuit, the complaint alleges that Sunwest and its 16 California residential care facilities have failed to comply with state laws and regulations for elder care facilities and have made false claims as to its services.

The class action complaint alleges unlawful business practices, unfair and fraudulent business practices, false advertising and violations of the state Consumer Legal Remedies Act.

The lawsuit charges that Sunwest and its facilities deliberately understaff their communities by forcing each one to operate under a budget designed to increase business profits by charging for services that were not provided.

The suit alleges that "defendants have misrepresented to the consuming public - in particular, the elderly residents at defendants' facilities and their family members - that defendants will comply with applicable laws and regulations. Defendants' representations are deceptive, misleading and made with the intent to induce elderly citizens to become residents at defendants' facilities under a false pretense, namely that defendants will provide the care and supervision required by law."

The suit asks for a court order requiring Sunwest Management and its retirement communities to "cease acts that constitute unlawful, unfair and fraudulent business practices," and also asks statutory, actual and punitive damages according to proof. No monetary amount was specified.

The residents allege that in violation of its contractual obligations, Illinois Power (IP) fails to inspect and maintain the connections between its wires and its customers' homes at the point of delivery, creating an elevated risk of fire. According to the complaint, IP is contractually required to perform basic inspections and maintenance activities to protect the safety of customers by minimizing known fire risks incident to the distribution of electricity.
 
A class action has been filed against Alameda County, California, and its Social Services Agency on behalf of thousands of people who allege that they are illegally denied food stamps and general assistance each year because they are not identified as having mental disabilities, in violation of the federal Americans with Disabilities Act and state disability and welfare laws.
 
A statewide class action has been filed against the National City Mortgage Company on behalf of all South Carolina residents who were issued a mortgage by National City Mortgage that understated the annual percentage rate of interest due to the fact that National City included fees for points and brokerage fees in the amount financed.
 
Lakefront property is only as valuable as the lake is beautiful. The class has been certified in an action filed against Tyson Foods, Inc., Simmons Foods, Inc., and Peterson Farms, Inc. on behalf of all private owners of lakefront property on Grand Lake O' the Cherokees in the northeastern corner of Oklahoma as of October 23, 2001. The defendants allegedly damaged the lake when they allowed toxic poultry waste to run off into it, in violation of state environmental laws.
 
The way to prevent being taken advantage of is to know your rights. The class has been certified in a Florida action filed against the Equity Residential Properties Trust and affiliated organizations on behalf of all Equity Residential Florida apartment tenants and their co-signers who moved or left their Equity Residential Florida apartment from December 1, 1998, to present, who signed an Equity form lease and who received a demand for fees resulting from “insufficient notice,” “early termination,” “cancellation,” “lease fulfillment,” “no notice given,” or “liquidated damages.” Persons eligible to take part in the action should contact the class attorneys for more information.
