Citizens Rights Violated in Immigration Raids

A civil rights group filed a lawsuit in federal court against the U.S. Immigration and Customs Enforcement, claiming that it harassed five U.S. citizens of Mexican descent solely because of their appearance during raids targeting illegal immigrants in southeast Georgia in early September.

The Southern Poverty Law Center alleges that federal agents were engaging in a campaign to drive Latinos out of the area.

The plaintiffs also include a trailer park landlord who claims his property was damaged when federal agents broke into numerous trailers.

The complaint, filed in the U.S. District Court for Northern District of Georgia, concerns a sweep in which more than 120 illegal immigrants were rounded up.

The center, based in Montgomery, Ala., is asking the court to certify the lawsuit as a class action.

A class action has been filed against Yale New Haven Hospitals for failing to provide healthcare services to Connecticut residents regardless of their ability to pay. The lawsuit alleges that Yale has an obligation to provide free or low cost healthcare services because it operates as a non-profit organization and is exempt from federal, state and local taxes.
 
A statewide collective action has been filed in Florida against All Restoration Services, Inc. The action is brought on behalf of all current and former employees, who since February 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
As the result of an alleged continuous pattern of labor violations, another collective action has been filed in Florida against the School Board of Broward County, Florida. The action is brought on behalf of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by the board. The action is brought under the federal Fair Labor Standards Act and is seeking back pay as well as statutory damages, liquidated damages and declaratory relief.
 
A class action has been filed against American Airlines, Inc., Airline Automation, Inc., and various other companies on behalf of all persons who have had personal and private information about them gathered and transmitted to third parties, in violation of the federal Electronic Communications Privacy Act. The action seeks at least $1,000 in statutory damages per class member for the illegal use of stored electronic communications, as well as other actual, statutory and punitive damages.
 
A national collective action has been filed in Florida against Morgan Tire & Auto, Inc. The action is brought on behalf of all current and former Managers, Assistant Managers and Managers in Training who were improperly classified as exempt employees and not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damage and back pay as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
