LendingTree Faces Class Action Lawsuit

A class action lawsuit has been filed against LendingTree and its subsidiary, Home Loan Center Inc. It alleges that the companies engaged in unfair business practices and false advertising.

LendingTree's Web site touts the company as a loan-origination service that allows lenders to compete for borrowers' business. The lawsuit contends LendingTree diverts LendingTree.com leads to its subsidiary, which conducts business under the name LendingTree Loans without any competition.

There, the suit says, borrowers are sold loans at inflated prices based on the false representation that competition for the business has occurred among lenders.

The lawsuit was filed in Orange County Superior Court on behalf of consumers.

Ralph Brooks, Jr., a Philadelphia man man who was shot and disabled when he was six years old, filed a lawsuit against Wachovia Bank, charging that the bank charged "sweep fees" for funds held in mutual funds set up with donations at the time of the shooting.
 
A statewide class action has been filed in Illinois against credit giant Experian Information Services as a result of allegedly fraudulent activities revolving around Experian's offer of free credit reports through its consumerinfo.com website. According to consumers, the offer of a "free" credit report is, in fact, a scam to get consumers to sign up for Experian's $79.95 CreditCheck service. The action is brought on behalf of all residents of the state of Illinois who, since November 5, 2000, utilized Experian's offer for a free credit report by entering their credit card or debit card information, and who were charged for Experian's CreditCheck service as a result and have not received a full refund of charges for this service. The action is brought under Illinois consumer protection statutes and seeks unspecified compensatory damages, injunctive and declaratory relief as well as disgorgement of all profits and compensation obtained by the defendants through their alleged fraudulent activities.
 
A class action lawsuit has been filed in the Eastern District Court of New York against Eckerd Corporation, a Florida based retailer, for violations of the Fair Debt Collection Practices Act. Class members seek injunctive and declaratory relief as well as damages, attorney's fees and costs.
 
A West Virginia woman has filed a class action lawsuit against Capital One Bank, accusing the company of violating the Fair Debt Collection Practices Act. Earlene West of Gandeeville filed the lawsuit on Nov. 16 in U.S. District Court. She alleges in her lawsuit that Capital One acquired several charged-off credit card accounts from Providian, including her own.
 
A statewide class action has been filed in California against collection specialist, Midland Credit Management, Inc., who operate under the name Kansas Midland Credit Management, Inc. The action is brought on behalf of all California residents who received a collection letter from Midland which offered to settle their alleged debt for a lesser amount, if payment was made immediately. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
 
The parties have reached a $1.6 million settlement in an action filed against Ameriquest Mortgage Company, on behalf of all persons who obtained Ameriquest, Argent Mortgage Company, Town & Country Credit Corporation; or Olympus Mortgage Company variable rate loans between June 1, 1998, and June 30, 2003, which were secured by real properties in the State of California, and who paid a prepayment charge in excess of that permitted by the California Civil Code. Persons with outstanding loans, who might still be subject to prepayment charges from these companies should also submit claim forms. Claim forms must be postmarked no later than November 19, 2004, to be considered valid.
