Pullen Seeds and Soils of Sac City, Iowa, filed a federal class action lawsuit against Monsanto, accusing the ag-chem and seed giant of using illegal tactics to keep its dominant share of the glyphosate market.
Dr. Roger McEowen, an agricultural law professor with Iowa State University states "the plaintiffs in the case claim Monsanto used a variety of anti-competitive tactics in its bid to control the glyphosate market. One is acquiring seed companies that were developing modified seed technology, eliminating projects that could have led to the development of genetically modified seeds that could be used with non-glyphosate herbicide." He continued "then also entering into exclusive dealing licenses with seed companies and dealers that denied actual and potential competitors access to developmental marketing and distribution channels." Monsanto has successfully turned away anti-trust accusations before, and no charges were leveled against the company after an anti-trust investigation by the Justice Department in 2003. But McEowen said this most recent case is different, because Pullen Seeds is accusing Monsanto of forcing seed dealers to distribute Monsanto's Roundup glyphosate brand as requirement for access to Monsanto seed technology. Other Environmental Cases of Interest A 1999 class action lawsuit against the city of Ferriday, Mississippi and the firm that built the local water treatment plant, stemming from a 124-day boil-water order, has settled for $2,537,500. A class action has been filed against St. Joe Paper Company and its successor, The St. Joe Company, on behalf of the residents of Millview, a neighborhood in the panhandle town of Port St. Joe, Florida. The suit alleges that the companies knowingly exposed the plaintiffs to hazardous substances. Eleven homeowners along the Delaware River filed a class action lawsuit against PPL Corporation over the massive coal ash spill in August of 2005. The lawsuit was filed in Pennsylvania's Commonwealth Court, and claims that PPL was "negligent, reckless and created a public nuisance following the massive failure of a 40-acre settling basin at the power company's Martins Creek plant over three days at the end of August."
A class action lawsuit has been filed in the state circuit court in Collier County, Florida against Orange Tree Utility Co. The lawsuit is brought on behalf of water customers of Orange Tree in the Naples area, who claim that the water fails to meet safe water standards, has an unpleasant appearance, taste and odor, and may cause health problems. The suit alleges that Orange Tree Utility Co. has consistently ignored consumer complaints about the quality of the water and seeks damages for medical bills, property damage and the cost of extra water filtration devices. The International Brotherhood of Teamsters filed a class-action lawsuit alleging that Nashville's Middle Metro Police department has neglected the police officers' pension fund by going six years without a performance audit to show how investments have performed. Chemtura Corporation announced October 18, 2005 that it has repealed certain parts of a Global Settlement Agreement in a class action lawsuit pending in the United States District Courts in the Northern District of California and the District of Connecticut. As announced last January, the Company reserved the right to cancel all or part of the Global Settlement Agreement based on the number of members of the applicable classes who exercised their opt out rights. As a result of opt outs in rubber chemicals and EPDM, the Company is currently negotiating settlements directly with the largest claimants in those actions. Chemtura does not intend to adjust the reserves previously established with respect to these lawsuits at this time. |
