Wells Fargo Settles Overtime Class Action Suit

Wells Fargo has settled a class action lawsuit contending the giant San Francisco-based bank had failed to comply with overtime laws.

The bank will put $12.8 million into a fund to be dispersed to about 4,500 current and former employees.

The amount each gets will vary based on length of employment with Wells Fargo & Co. in a covered position, specific position held, salary, and whether the employee worked in California, where the recovery would be greater, or elsewhere.

The lawsuit by Wells Fargo Business Systems consultants and e-Business Systems consultants alleged violations of the Fair Labor Standards Act, California’s Unfair Competition Law and wage and hour laws, and the Employee Retirement Income Security Act.

Morgan Stanley settled a gender bias class-action lawsuit for $46 million. The suit was brought against the Wall Street firm by eight former and current employees who charged that Morgan Stanley deprived them of the trainings, pay raises, and opportunities for promotion that were available to male employees.
 
The parties have reached a proposed $1.33 million settlement of a class action against Lane Bryant, Inc. on behalf of all persons who were employed as a store sales manager at a Lane Bryant store in California at any time between October 27, 1997, and July 7, 2003. To recover under the settlement, class members must submit a claim form postmarked no later than September 23, 2003.
 
A class action lawsuit has been filed in the Southern District Court of Florida against SPF, Inc. (DBA the King's Head). The case involves violations of the Fair Labor Standards Act which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. No additional information about the substance of the allegations is available at this time. A national collective action has been filed in Florida against home loan specialist, Mortgage Investors Corporation. The action is brought on behalf of all current and former Mortgage Investors loan officers who, since June, 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week and/or proper minimum wage for all hours worked. The action is brought under the federal Fair Labor Standards Act and seeks back pay, compensatory, statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
State Farm Insurance Company claims adjusters stand to gain about $135 million under a class action settlement approved January 17, 2005 by Los Angeles Superior Court Judge Anthony Mohr, an attorney for the plaintiffs said. The statewide class of adjusters sued for unpaid overtime. Plaintiffs attorneys said many adjusters will be receiving back payments in excess of $50,000.
 
Federal law protects workers from unexpected job losses due to unexpected layoffs. A $1.27 million judgment has been entered against the Chicago Housing Authority in favor of police officers, security officers, and employees in the authority's police department, which was closed in October 1999 without giving 60 days' notice to workers, as is required under the federal Worker Adjustment and Retraining Notification Act (WARN Act), thereby violating the act.
