Philadelphia Common Pleas Judge Mark I. Bernstein rejected a proposed settlement of a tentative class action stemming from the recall of roughly 162,000 Isuzu SUVs due to defective brake systems. In his recent nine-page order in Parker v. American Isuzu Motors Inc., Bernstein argued that certain requirements of the proposed settlement -- such as that class members would need to produce a police report that supported their claim in order to receive compensation -- might cause plaintiffs undue difficulty.
 
A U.S. Court of Appeals in Cincinnati has ruled that a dispute over sticking gas pedals on 1999 and 2000 Mercury Villager minivans belongs in a single, class-action trial.
 
Two Michigan men filed a lawsuit against a maker of tires for recreational vehicles they say are defective and pose a safety risk. Jeffrey Hunsaker, of Byron Center, and Dennis Drooger, of Holland, filed the suit against Carlisle Tire & Wheel Co. last January in Kalamazoo.
 
State Farm, the nation's largest auto insurer, continued to resell thousands of vehicles nationwide without disclosing they had been in wrecks even though the company had agreed years earlier to stop the practice. The company announced it would pay $40 million to owners of thousands of totaled vehicles that State Farm had sold without state salvage titles, as required by law. The company says the practice was a mistake.
 
If you own a Class A or Class C Fleetwood Enterprises recreational vehicle, you may need a supplemental braking system if you tow loads approaching 3,500 pounds. The parties have reached a settlement apparently valued at $8.55 million in an action filed against recreational vehicle manufacturer Fleetwood Enterprises, Inc. on behalf of original owners of 1994-2000 Fleetwood Class A or Class C motor homes who still own their RVs. Claim forms must be postmarked by April 18, 2004 to be considered valid.
 
Vehicle leases, like other contracts, are governed by the actual language within the contract itself, and the parties may not add or subtract anything from that agreement. A Florida class action has been filed against auto leasing company U.B. Vehicle Leasing, Inc., on behalf of vehicle lessees who allege that the company charged them "taxes" that were actually just undisclosed fees to cover wear and tear, and excess mileage on the vehicles, in violation of Florida consumer protection laws and the federal Consumer Leasing Act.
