Class Action Filed Against Nevada Child Welfare

A class action lawsuit was filed against the state of Nevada and Clark County for failing to protect abused and neglected children in the child welfare system.

The National Center for Youth Law filed the lawsuit, which also personally names Governor Kenny Guinn, state Health and Human Services Director Michael Willden, and Clark County officials.

The suit charges the defendants with causing serious harm to child in the system. The suit does not seek money, it asks for system-wide reform.

The suit points out that at least 79 children have died of abuse of neglect at the hands of their parents, foster parents, or other caregivers while under the watch of the Clark County Department of Family Services.

The suit also claims there has been much documentation of the county's failure to protect children in the foster care system and that the system hides "behind a veil of confidentiality meant to protect children and families, but which the county has used to shield itself from oversight and criticism."

Mike Willden, who is named in the lawsuit, recently spoke out about the possibility of a lawsuit.

"A lawsuit on the other hand may be the best thing that happens because it'll ultimately help get services to kids sorely needing services. But it pulls away a lot of resources to go to the lawyer up mode," he said.

A proposed $3.9 million judgment has been entered in an action filed against the Hawai'i Child Support Enforcement Agency on behalf of certain persons who allege that they received less in child-support payments than they expected between 1996 and the end of 2002. Claims must be filed by November 23, 2003, to be considered valid.
 
A class action lawsuit has been filed on behalf of non-custodial parents in the state of South Dakota. The suit alleges that the enforcement of child support and custody laws by the state’s courts and agencies unlawfully and unconstitutionally interferes with the parental rights of non-custodial parents.
 
The popular Miami Hotel, The Biltmore, has decided to repay patrons who resided there between May 1999 and the present day, after a class action lawsuit was brought against it. The suit alleges a $7.00 service charge billed to hotel patrons was unfair and deceptive, as many never knew about the fee, meant to cover the use of The Biltmore Hotel's fitness center, delivery of a daily newspaper, and the cost of local calls placed from in-room phones.
 
The South Dakota Coalition of Schools, an advocate group for public education, filed a lawsuit that would challenge the state's constitution on education funding. The main concern is if the schools are adequately funded. The state's constitution mandates the legislature to "adequately" fund public education. However, dozens of school districts believe lawmakers are failing to fund the schools, so the districts filed the lawsuit in hopes of taking them to court in hopes of getting more money.
 
Kahn Gauthier Swick is investigating possible legal actions on behalf of persons harmed by exposure to asbestos. It is estimated that half a million legal actions have been filed to recover for injuries and deaths resulting from asbestos.
