Security System Employees File Class Action Lawsuit |

Current and former employees of Inter-Con Security Services filed a class-action lawsuit accusing the firm of violating federal and state laws by withholding overtime pay for security guards at Kaiser Permanente hospitals and other locations in California.
According to the law firm handling the lawsuit, the plaintiffs in the lawsuit number around 2,000 security guards in California as well as "possibly many more" across the country.
The attorney that filed the lawsuit said the class-action lawsuit, which was filed in U.S. District Court in San Francisco, seeks several millions of dollars in damages as well as an injunction requiring Inter-Con to pay overtime wages for all hours worked.
Inter-Con requires employees to arrive 15 minutes early for their shifts for an obligatory security briefing but does not pay workers for their time, according to the Service Employees International Union.
The overtime due to each employee arriving 15 minutes early amounts to an average of $1,000 a year, according to the union.

A class action has been filed on behalf of workers who claim they were wrongfully classified as independent contractors, and therefore denied the benefits due employees, by high-tech logistics provider Henry Industries d/b/a River City Courier and Henry Industries Courier Network. The complaint alleges that Henry Industries violated the Federal Fair Labor Standards Act by improperly classifying many workers as independent contractors in order to avoid paying them benefits and overtime, and then passed those savings on to clients in order to undercut competitors. Plaintiffs seek employee status, unpaid wages, punitive and liquidated damages, and equitable relief. A statewide collective action has been filed in Florida against A.M.A. Pretzels II, Inc., who conduct business under the name Auntie Anne's Pretzels. The action is brought on behalf of all current and former employees, who since April 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members. Earl Scheib, Inc. reached an agreement to settle a class action lawsuit related to how the Company's California division classified certain employees under California overtime law over an approximately seven year period.
