A U.S. Court of Appeals in Cincinnati has ruled that a dispute over sticking gas pedals on 1999 and 2000 Mercury Villager minivans belongs in a single, class-action trial.
The ruling upheld a decision by U.S. District Judge Susan Dlott to certify a class-action lawsuit filed by Pat Daffin of West Price Hill, Ohio. Owner of a 1999 Villager, Daffin filed suit against Ford Motor Co. in 2000. He alleges that thousands of Ohioans bought or leased Villagers with throttle body assemblies that can leave gas pedals stuck in acceleration. The panel ruled that class litigation is the "superior method" of settling the dispute in court. Nearly 60 other Villager owners complained about balky gas pedals in complaints filed with the National Highway Transportation Safety Administration as of mid-2004. Other Automotive Cases of Interest A class action has been filed against Aetna Health, Inc., a subsidiary of healthcare giant Aetna, Inc., on behalf of Pennsylvania residents (1) who, between September 26, 1999, and the date of the final judgment in the action, were injured in a motor vehicle accident while insured under an Aetna heathcare plan; and (2) whose tort recovery from the accident was subject to a lien asserted by Aetna. The action seeks compensatory and statutory damages for monies collected via the liens as well as injunctive and declaratory relief.
Many Los Angeles-area consumers shopping at Drive Time (formerly known as Ugly Ducking) for used cars usually filled out credit applications containing all of their confidential financial information, including name, social security number, employment information and home address. These consumers assumed that Drive Time would keep these credit applications under lock and key and not leak them to anyone outside of Drive Time. Owners of certain GM SUVs and Trucks have reported problems with their speedometers. A national class action has been filed in South Carolina against the Kubota Tractor Company. The action is brought on behalf of all U.S. residents or entities (except those residing in Louisiana) who have purchased a Kubota M-8200 or M-9000 tractor within 3 years of February 3, 2004. The action alleges that these tractors contain defective clutch discs and seeks the rescission of the sales of the defective tractors, or in the alternative, the repair and replacement of the clutch discs at no charge to the class members. The action is brought under the Uniform Commercial Code, which is recognized in all states except Louisiana and the laws of negligence. Federal credit and banking laws prohibit credit providers from discriminating based on ethnicity, national origin, or race. The parties have reached a tentative settlement in a nationwide action filed against General Motors Acceptance Corporation on behalf of African Americans who allege that, as a result of company policies, dealers routinely charged black consumers higher interest rates on auto loans than whites with similar financial histories in violation of the federal Equal Credit Opportunity Act. Persons eligible to take part in the settlement should contact attorneys for the class for more information. Many individuals have additional coverage with their car insurance called a rental car rider policy. This policy insures that if you are in an accident and your car is in the shop being repaired, the insurance company will pay for your rental car. It has recently come to the attention of Kahn Gauthier Swick that individuals who purchased State Farm Auto Insurance with the Rental Car Rider may not have received all of the benefits under the policy. |
