Judge Says Airport Noise Lawsuit Can Proceed

Report Fraud
Case ID: 4897 | Miscellaneous | 08/14/2006

A judge says about 3,500 Richfield and Minneapolis homeowners can proceed with a class action lawsuit against the Metropolitan Airports Commission. The homeowners are seeking more than $140 million in additional money for noise-proofing their homes near the Minneapolis-St. Paul International Airport. A trial is set for February.

"The court's ruling is an important step toward holding the MAC accountable for what it promised these homeowners," said their lawyer.

The MAC has already soundproofed the homes that get the most noise from the airport.

This lawsuit centers on the next tier of homes, those experiencing noise levels in the 60-64 decibel range.

The MAC contends it never guaranteed full noise insulation for these homeowners. It's currently spending $28 million to provide partial soundproofing for about 3,600 homes in that range.

The lawsuit seeks full noise insulation, at a cost of over $157 million.
