Copyright and Patent Lawsuit Filed Against Honeywell Batteries

The Enterprise Mobility Company filed a lawsuit against Harvard Battery, Inc. and Global Technology Systems, Inc. d/b/a Honeywell Batteries for copyright, design patent and utility patent violations. The lawsuit, which seeks class action status, alleges both companies are selling batteries that infringe Symbol's intellectual property.

In the complaint, Symbol is seeking an injunction to prevent further sales of infringing batteries, as well as monetary damages.

Other Consumer Products Cases of Interest

The parties have reached a final $10.7 million settlement in several actions filed against online flower delivery business FTD.Com, Inc. and its parent, IOS Brands Corporation, by stockholders who purchased FTD.Com class A common stock between March 1, 2002, and June 27, 2002. The actions claim that the defendants violated federal securities laws by breaching their fiduciary duties in conjunction with the companies’ 2002 reorganization. Persons eligible to take part in the settlement must submit proof of claims forms postmarked no later than May 13, 2004.
 
Several class actions have been filed against gym franchiser Bally Total Fitness Holding Corporation (NYSE:BFT) and certain of its officers and directors by stockholders who purchased the company's common stock between August 3, 1999, and April 28, 2004. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
GE brings good things to life, except when its dishwashers catch fire. The parties have reached a $780,000 settlement in an enforcement action filed against manufacturing giant General Electric Company on behalf of New York consumers who allegedly purchased new GE dishwashers in 1999. The action alleged that the company convinced consumers to purchase new dishwashers by fraudulently concealing the availability of a quick, inexpensive repair that would prevent fires in certain recalled models. Eligible claimants should contact the New York State Attorney General's office for information on the settlement.

An FTC administrative proceeding has been filed against the Internet Marketing Group, Inc., and affiliated businesses OneSetPrice, Inc., RPM Marketing Group, Inc., National Events Coordinators, Inc.; First Choice Terminal, Inc.; First Choice Terminal, Inc.; and B & C Ventures, Inc., on behalf of consumers who bought into multipurpose public access Internet terminal and telephone calling card business ventures since August 2001. The action accuses the defendants of making false and unsubstantiated earnings claims, and misrepresenting their cancellation and refund policies, in violation of the FTC's Franchise Rule and Telemarketing Sales Rule.
 
Three smokers who pay Minnesota's 75-cent-per-pack "health impact fee" that a judge has declared illegal want their money back. The smokers filed a lawsuit that seeks class action status on behalf of all the state's smokers.
