The Center for Science in the Public Interest, a food industry watchdog group, is suing KFC over an allegedly serious health threat from KFC chicken, potato wedges, pot pies, and other dishes cooked with partially hydrogenated oil. The food industry watchdog group filed the class-action lawsuit against Yum Brands KFC unit for cooking chicken and other foods in oil that contains artery-clogging trans fat. The lawsuit seeks to end KFC's use of partially hydrogenated oil in fried chicken and other dishes.
CSPI Executive Director Michael Jacobson says the chain's use of partially hydrogenated oils turns healthy food into something that can take years off your life. "We're announcing a lawsuit being filed against Yum Brands, the owner of KFC restaurants, for preparing KFC's chicken, potato wedges, pot pies, and other dishes with partially hydrogenated oil. The problem with partially hydrogenated oil is that it is the major source in our diet of trans-fat, a potent cause of heart disease" said Jacobson. If the lawsuit comes up short, the group wants the District of Columbia Superior Court, where the suit was filed, to order KFC to post signs notifying customers that many of the chain's foods are high in trans fat. Such artery-clogging fat is found in abundance in partially hydrogenated oil. "Strict labeling requirements have reduced the popularity of trans fats in packaged foods, but restaurants don't have to adhere to the same rules," said Penny Kris-Etherton, a professor of nutritional sciences at Penn State University. "Most of the big restaurant chains remain major users of trans fats. However, Wendy's International Inc. recently said that it would begin frying its French fries and breaded chicken items with non-hydrogenated oil" continued Kris-Etherton. "Partially hydrogenated oils are used extensively in the restaurant business because they have a long shelf life and are well suited for cooking crispy, crunchy foods" said Kris-Etherton. "Despite the versatility and pleasing taste of the oils, there is a broad scientific consensus that trans fats are unhealthy, contributing to high cholesterol and heart disease" she added. The watchdog group is using a District of Columbia law that allows consumers to seek relief from the courts when companies fail to disclose essential facts about their products. The lawsuit asks for attorney's fees and monetary damages, which could amount to $1,500 per violation. Class members do not need to take any action at the present time to remain eligible. The parties have reached a tentative $1 million settlement in a class action filed against Cheap Tickets, Inc., on behalf of stockholders who held the company's common stock between August 13, 2001, and October 5, 2001. The action claimed that the defendants violated federal securities laws by breaching their fiduciary duties to shareholders in connection with the sale of Cheap Tickets to Cendant Corporation. Persons eligible to take part in the action must submit claim forms postmarked by July 30, 2004, to receive a share of the settlement. A class action has been filed against body armor manufacturer Armor Holdings, Inc., on behalf of all persons, agencies, or entities that purchased, owned, have been issued, or possess vests containing Zylon, manufactured by Armor Holdings between April 7, 1999, and April 7, 2004. The action alleges that Zylon, the protective fiber used in the vests, deteriorates when exposed to heat and other conditions over time so that the vests lose their protective qualities. Several class actions have been filed against power utility Canadian Superior Energy , Inc. (AMEX:SNG, TSX:SNG) and certain of its officers and directors by stockholders who purchased the company's common stock between November 17, 2003, and March 11, 2004. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. Size matters in the rapidly advancing world of computer peripherals. A class action has been filed against Apple Computer, Inc.; Dell, Inc.; Gateway, Inc.; Hewlett-Packard Company; International Business Machines, Inc.; Sharp Electronics Corporation; Sony Corporation; and Toshiba Corporation on behalf of computer hard drive purchasers who allege that the companies' advertising deceptively overstates their hard drives' true capacity in violation of California consumer protection laws.
Even department stores and perfume companies can fix prices, it seems. On March 30, 2005 the court granted final approval for a $175 million settlement in an action filed against major department stores and cosmetic makers on behalf of U.S. residents who purchased certain cosmetics and fragrances from the defendant department stores between May 29, 1994, and July 16, 2003. The action alleged that the stores and manufacturers conspired together to fix prices in violation of federal antitrust laws. Claims must be postmarked on or before March 26, 2004, to be considered valid. |
