Ryland Homeowners May Enter Class Action

Potentially hundreds of Ryland homeowners whose homes were damaged during the 2004 hurricanes are allowed to join a class-action arbitration. An arbitration is the process by which both parties dispute their differences to the judgment of an impartial person, usually called an arbitrator, who is appointed by mutual consent.

Fifty to 80 homeowners are involved in the arbitration case, which involves homes built between 2000 and 2005, said one of the attorneys for the homeowners.

"Homeowners in the Orlando, Tampa and Fort Myers, Florida areas will be contacted in the coming weeks and have the option of not participating in the arbitration, said an attorney handling the case.

The homeowners filed the lawsuit in March 2005, after their homes were damaged during the storms because of shoddy work on the exterior finish that allowed water to leak inside.

A class action has been filed against Leviton Manufacturing Company, Inc. on behalf of South Carolina residents whose homes have an allegedly unsafe type of electrical outlet--a back plug-in outlet--manufactured by Leviton in violation of state consumer safety laws. The action seeks unspecified compensatory damages.
 
Donating one’s body for the advancement of the medical arts and sciences is truly noble act. A class action has been filed against Johnson & Johnson, Empire Anatomical Services, Depuy Mitek, Inc., and certain individuals on behalf of all persons who are closely related to a person whose remains were donated to UCLA's Willed Body Program while Henry Reid was the program's director between 1997 and 2004. The action alleges the defendants have engaged in the practice of buying and selling whole and dismembered human remains without regard for the rights of families of the deceased individuals, in violation of California law and the federal Racketeer-Influenced and Corrupt Organizations (RICO) Act.
 
The parties have reached a $1.65 million settlement in an administrative proceeding filed against Fairbanks Capital Corporation on behalf of nearly 40,000 Florida borrowers over claims that the company required illegal late fees and other charges. Persons eligible to take part in the settlement should contact the attorneys who prosecuted the action.
 
On September 28, 2005, a three judge appeals panel in Florida granted class-action status to the plaintiffs in a lawsuit against the Pinellas County School Board. The lawsuit alleges educational inequity. The decision allows more than 20,000 African-American families to stand together in their claim that the board has failed to ensure African-American students are properly educated.
 
Before you enter into a mortgage agreement, read the entire contract very carefully--if you need to, get an unbiased professional to go over it with you. The parties have reached a tentative settlement, apparently valued at $1.2 million, in an action filed against Ameriquest Mortgage Company on behalf of borrowers who allege that the company miscalculated the amounts of the borrowers' prepayment penalties for paying off mortgages that were taken out between September 1998 and October 2001 on California property. The claims deadline has been extended from December 9, 2003, to July 30, 2004. Claims must be submitted by the new date to be considered valid.”
