Attorneys File Lawsuits Against Verizon, AT&T, BellSouth for Violation of Privacy Laws

Lawyers have recently filed class action lawsuits on behalf of millions of persons in the United States who are residential customers of telephone or Internet services provided by Verizon, AT&T and BellSouth. The Complaints allege that the National Security Agency ("NSA") began a classified surveillance program shortly after September 11, 2001, to intercept the telephone and Internet communications of persons inside the United States without judicial authorization, a program that continues to this day. As part of the program, the NSA intercepts millions of communications made or received by people inside the United States, and uses powerful computers to scan their contents for particular names, numbers, words or phrases.

According to the Complaints, the Attorney General has admitted that, absent additional authority from Congress, the electronic surveillance conducted by the Program requires a court order under the Foreign Intelligence Surveillance Act of 1978. The President and other government officials have admitted that the NSA does not seek judicial review of the Program's interceptions before or after the surveillance, whether by the Foreign Intelligence Surveillance Court or any other court.

The plaintiffs claim that in violation of the Electronic Privacy Act of 1986, Verizon, AT&T and BellSouth provided customer records to the government. The privacy Act bars the telephone carriers from turning over information about calls except in extremely limited circumstances. The suit seeks the minimum penalty of $1,000 for each person whose information was compromised.

"The phone companies that participated in this surveillance program could be on the hook for billions of dollars in damages," said an attorney for the plaintiffs. "It appears that the telephone companies turned over millions of records and the privacy act provides of a minimum penalty of $1,000."

The lawsuit involves any residential customer of Verizon, AT&T and Bellsouth who telephoned overseas.

Other Miscellaneous Cases of Interest

The parties have reached a $16 million settlement in a class action filed against energy provider Cleco Corporation on behalf of 264,000 electricity customers across Louisiana. The action alleged that the utility improperly engaged in "round-trip trades" involving power sales from Cleco affiliates to an unnamed trading partner, who then sold the power back to another Cleco affiliate. The way to prevent being taken advantage of is to know your rights. The class has been certified in a Florida action filed against the Equity Residential Properties Trust and affiliated organizations on behalf of all Equity Residential Florida apartment tenants and their co-signers who moved or left their Equity Residential Florida apartment from December 1, 1998, to present, who signed an Equity form lease and who received a demand for fees resulting from “insufficient notice,” “early termination,” “cancellation,” “lease fulfillment,” “no notice given,” or “liquidated damages.” Persons eligible to take part in the action should contact the class attorneys for more information.
 
A Texas law firm filed a class-action lawsuit on October 6, 2005 against Sprint Nextel Corporation on behalf of thousands of landowners in the state. The suit, filed in federal district court in Kansas, claims Sprint Nextel used exclusive electricity transmission towers to erect cellular phone antennae without obtaining approval from property owners.
 
Dickson Campers alleges that the city of Mobile violated state law by collecting more taxes inside its 3-mile-wide police jurisdiction, which extends west and south of the city, than the services it provides there. The city also has not -- on an annual basis as it should have -- justified the amount it collects..
 
The parties have reached a tentative $4.5 million settlement in an action filed against healthcare supply company APO Health, Inc. on behalf of all persons with an Indiana telephone number who received an unsolicited fax advertising APO Health products. The action alleged that the company violated the federal Telephone Consumer Protection Act by sending the faxes. Persons eligible to take part in the settlement should contact attorneys for the class as soon as possible.
 
A class action lawsuit has been filed in the United States District Court, Southern District of New York against Western Gas Resources, Inc. and Hunter Shively. The case involves violations of antitrust law. No additional information about the substance of the allegations is available at this time. On October 29, 2004, the Court ordered this case to be consolidated with Cornerstone Propone v. Reliant Energy et al.
