Employees File Lawsuit Over Back-Pay

Former employees recently sued Software publisher Activision for failure to pay overtime compensation as required by California law. The lawsuit alleges that Activision unlawfully classifies its Computer Graphics employees as exempt from California's laws requiring overtime pay. One of the attorneys working on the case announced that "Activision's Computer Graphics employees, who work many overtime hours to produce Activision's profitable videogames, fully deserve to be paid all the overtime compensation to which they are entitled under the law."

The plaintiff is seeking an award for unpaid wages, penalties and punitive damages to current and former employees who were wrongfully denied overtime pay.

The lawsuit is open to any California resident that is a current or former employee of Activision that was denied overtime pay.

A national collective action has been filed in Florida against consumer electronics giant, Radioshack Corporation. A class action lawsuit has been filed in the District Court of New Jersey against Clement-Pappas Company, Inc., a New Jersey based wholesaler, for violations of the Family Medical Leave Act (FMLA). Class members seek a declaratory judgment that the defendant's policies and practices violate the law, seek reinstatement, damages for lost income and benefits, compensation for emotional distress, anguish and humiliation, punitive and other damages, and attorneys' fees and costs.
 
A class action lawsuit has been filed in the District Court of Connecticut against Mothers Work Inc. for violations of the Fair Labor Standards Act (FLSA) which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. Class members seek damages, costs and attorney's fees.
 
A lawsuit was filed in New Orleans federal court against Decatur Hotels and Chief Executive F. Patrick Quinn III, claiming that the hotel company found a legal way to bring in workers from Latin America, and later exploited the workers in violation of U.S. Labor Law.
 
A statewide collective action has been filed in Florida against Southeast Milk, Inc. The action is brought on behalf of all current and former employees of Southeast who have not been paid overtime wages for all hours worked in excess of 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as back pay, injunctive and declaratory relief. As a collective action, all potential claimants must "opt-in" and consent to be members of the class. The employees have requested that the court issue notice to all potential claimants.
 
A class action lawsuit has been filed in the Northern District Court of Illinois against Focus Environmental Contractors, LLC, DBA Focus Environmental Monitoring DBA Fec II DBA Esci AKA Environmental Success Construction, Inc. The case involves violations of the Fair Labor Standards Act. No additional information about the substance of the allegations is available at this time.
