Miami Condo Owners File Class Action Lawsuit

Buyers at the failed 1390 Brickell Bay condominium tower have filed a class-action lawsuit against developer Kenneth Baboun and his company BBB Group claiming fraud and breach of contract.

Baboun pulled the plug on the proposed 49-story condo near Miami's Brickell Avenue in February, saying hurricane-related delays and rising construction costs doomed the project. He returned buyers' deposits, which amounted to 20 percent of their purchase price earlier this year.

Over 50 buyers have sued in Miami-Dade Circuit Court alleging they were defrauded when Baboun announced groundbreaking in June 2005 but was far from ready to start construction. At groundbreaking buyers were required to put down the second 10 percent deposit on their units.

Baboun's lawyer, Lee Stapleton Milford of Baker & McKenzie in Miami, responded that the complaint is ''baseless,'' calling it ``a shakedown attempt -- a way to get a condo windfall without purchasing a condo in today's very difficult market.''

The condo was to go up at 1390 Brickell Bay Dr. in Miami and was Baboun's only project in South Florida. Baboun, 25 years old and a Mexico native, started the project with no previous high-rise experience.

The plaintiffs seek not only interest on their deposit but the value of the condo if it had been built. Walroth-Sadurni said that if Baboun can be shown to have acted in bad faith the plaintiffs are due the benefit of their bargain, not merely a returned deposit plus interest.

''We think the money damages per each unit is $200,000 and up,'' said an attorney for the condo buyers, noting that many buyers purchased their units in 2003 when prices -- even with a currently cooling market -- were much lower than today. Such a calculation in the 369-unit project would vault the total damages into the many millions.

Meanwhile, the suit gives a glimpse into who some of the buyers are for Miami condos. Thirty five of the 56 plaintiffs are from Colombia. The rest come from areas including Venezuela, Mexico, England, New York, North Carolina and Miami.

The lawsuit is open to anyone that purchased a Brickwell Bay Condominium located in Miami, Florida.

Other Consumer Products Cases of Interest

Two bands, Allman Brothers Band and Cheap Trick, have sued Sony BMG for underpaying them for digital downloads of their music. The class action suit, filed in a New York District Court, alleges that Sony BMG does not share 50 per cent of the net licensing revenue generated by digital downloads with music artists. According to the lawsuit, the bands are given only 4.5 cents per 99-cent download, instead of the 30 cents that they are entitled to. This is because each download is treated as a sale of a cassette or a CD even though it is not. So a charge of 20 per cent is deducted for containers and packaging of the product, and a further 50 per cent for 'audiofile'.
 
A class action has been filed against International Paper Company (Int'l) by Presswire Printing Company alleging that Int'l and others conspired in restraint of trade to artificially raise, fix, maintain or stabilize the price of publication paper in the United States from 1990 to the present.
 
Several class actions have been filed against tool manufacturer Spear & Jackson, Inc. (OTC:SJCK.OB) and certain of its officers and directors by stockholders who purchased the company's common stock between July 14, 2003, and April 15, 2004. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
A Fort Smith attorney has filed a class-action lawsuit against Arkansas Oklahoma Gas Corporation, (AOG) claiming the company overcharged its customers. The lawsuit was filed on behalf of several named clients, as well as all customers of AOG.
 
A class-action lawsuit recently filed claims that Reebok International violated a California law forbidding retailers to request personal information such as phone numbers from credit card customers. The alleged violations occurred at California outlet stores Reebok and its sibling brands Rockport, Ralph Lauren Footwear and Greg Norman Stores.
 
The parties have reached a tentative $750,000 settlement of a class action filed against adult entertainment and multimedia enterprise Metro Global Media, Inc. (Pink Sheets: MGMA, formerly OTCBB: MGMA) and certain of its officers and directors by stockholders who purchased the company's common stock between September 13, 1996, and September 13, 1999. To recover under the settlement, a completed proof of claim postmarked no later than October 27, 2003, must be mailed to the claims administrator.
