Allman Brothers and Cheap Trick Sue Sony BMG for Underpaying

Two bands, Allman Brothers Band and Cheap Trick, have sued Sony BMG for underpaying them for digital downloads of their music. The class action suit, filed in a New York District Court, alleges that Sony BMG does not share 50 per cent of the net licensing revenue generated by digital downloads with music artistes.

According to the lawsuit, the bands are given only 4.5 cents per 99-cent download, instead of the 30 cents that they are entitled to. This is because each download is treated as a sale of a cassette or a CD even though it is not. So a charge of 20 per cent is deducted for containers and packaging of the product, and a further 50 per cent for 'audiofile'.

In addition, the amount to be paid is calculated only on 85 per cent of the sales keeping in mind the breakage of the product. These charges are inapplicable to digital downloads as no physical music product is involved.

“I feel strongly that the record company is doing the wrong thing. Sony Music is presently engaged in a widespread attempt to underpay its recording artists; with the technological advancements in the music industry, it is essential that artists receive the royalty income to which they are entitled,” said an attorney for the bands.

The two bands are old ones and the deals they signed were before digital music became popular. Allman Brothers signed the deal in 1989, while Cheap Trick did so in 1976 and for these deals Sony uses a pay scale that's on par with traditional record sales.

The lament is an old one, and artists claim that the deductions for packaging the music under the agreements are applicable only in case of cassettes and CDs. “This has been the elephant in the room for a while. If you don't dispute the accounting now, that establishes how it's going to be in the future,” said the manager of Cheap Trick band.

The lawsuit is looking at including about 2,500 bands that signed deals with Sony between 1962 and 2002.

Three unhappy customers suing TV psychologist "Dr. Phil" McGraw over his now discontinued Shape Up! diet plan have asked that the case be given national class-action status to include thousands of potential plaintiffs. The Superior Court suit was filed last year claiming McGraw defrauded fans with his yearlong venture into the diet supplement business. A judge could rule on the request for class-action status early next year.
 
The parties have reached a $535,000 settlement in an FTC administrative proceeding filed against Special Data Processing Corporation (SDP) of Clearwater, Florida, on behalf of all persons who purchased subscriptions to the Triad Discount Buying Service. The action alleged that SDP violated FTC regulations by failing to disclose adequately that consumers had to cancel Triad within 30 days to avoid having their credit cards charged an annual fee, and that their cards would be charged a renewal fee each subsequent year unless they canceled the membership. Persons eligible to take part in the settlement should contact the attorneys who prosecuted the case for more information.
 
Even department stores and perfume companies can fix prices, it seems. On March 30, 2005 the court granted final approval for a $175 million settlement in an action filed against major department stores and cosmetic makers on behalf of U.S. residents who purchased certain cosmetics and fragrances from the defendant department stores between May 29, 1994, and July 16, 2003. The action alleged that the stores and manufacturers conspired together to fix prices in violation of federal antitrust laws. Claims must be postmarked on or before March 26, 2004, to be considered valid.
 
Even the most durable structure will decay if it has a defective roof. A class action has been filed against Pacific Coast Building Products on behalf of consumers who allege that the company’s Pabco HO-25 (also known as HZ-25 and Horizon) roofing shingles do not hold up as guaranteed, and as a result, caused damage to the buildings on which they were installed. The action alleges that the company violated Washington consumer protection laws when it marketed the shingles knowing that they would not withstand normal weathering processes.
 
Kahn Gauthier Swick is investigating possible legal actions on behalf of persons who contracted hepatitis A in outbreaks this fall in Pennsylvania, North Carolina, Georgia and Tennessee. The outbreak in Pennsylvania was the largest, with 615 cases as of November 25, including three deaths. Some 300 people were sickened in the other three states.
