SunTrips Drops Flights and Tours, Leaving Travelers in a Bind

Report Fraud
Case ID: 4745 | Miscellaneous | 04/05/2006

The San Jose tour company formerly known as SunTrips left many would-be travelers and travel agents empty-handed. Vacationers and travel agents are out millions of dollars since the company that arranged low-cost charter tours to vacation spots like Mexico and Hawaii canceled tours and stopped offering flights.

The tour group was FS SunTours Inc. doing business as SunTrips. FS SunTours is now processing refunds for people whose flights were canceled. When a company representative was reached for comment, he said the company is dedicated to processing refunds as quickly as possible, but would not say when they could be expected.

Travel agents are trying to get $1.8 million in commissions owed to them through a class-action lawsuit filed against the tour group by a San Francisco travel attorney.

Sun Trips operated as many as 16 charter flights a week from Oakland International Airport during peak summer months last year.

"Their impact at Oakland Airport was minimal," said an airport spokeswoman, who indicated her SunTrips contacts no longer worked for the company or were not answering calls.

Travel agent Rob Hunter, owner of Your Vacation Center in Sacramento, is owed about $18,000, and is part of the class-action suit filed in Santa Clara Superior Court. "I think the only way for me to ever get any money back is through legal action," Hunter said. Hunter is owed bills from Aug. 10, for commissions and cooperative marketing ads in newspapers. "We stopped the marketing in October when they stopped paying the bills."

Other Miscellaneous Cases of Interest

A Burlington County Superior Court judge has granted class-action status to cases filed in connection with the July 2004 flood in Burlington County. Judge Harold B. Wells found that the large number of claims, similarity of damages, and allegations against dam owners met the criteria for consolidating the cases as a class action.

John Alleman filed a class action lawsuit in U.S. District Court for the Southern District of Illinois against Wholesale Connection of Longwood, Fla. over two unsolicited faxes received at his Carbondale business.

A lawsuit which seeks class action status on behalf of California consumers has been filed against Cost Plus World Market for selling unassembled furniture while failing to disclose in its advertising that the furniture is unassembled.

The U.S. Federal Trade Commission has charged Canadian defendants Pinacle Publishing and M.D.S.C. Publishing with scamming small businesses and charities in the United States out of millions of dollars by billing them for business directory services they did not order or authorize, in violation of federal law. The FTC charges that the defendants refuse consumers’ requests to cancel the services, and use an in-house collection service to harass consumers whose accounts allegedly are past-due.

Land use agreements are often tailored to one specific use--other uses than those agreed-upon may be prohibited. A class action has been filed against Entergy Louisiana, Inc. and three sibling companies on behalf of Louisiana property owners who allege that the power utility conspired to illegally increase its profits by misusing fiber optic cables in easements on their land in violation of state law and the federal Racketeer Influenced and Corrupt Organizations Act.

A class action lawsuit has been filed in the Eastern District Court of Texas against Offshore Specialty Fabricators, Inc. for violations of the Racketeering Act (RICO), among other things. The Racketeer Influenced and Corrupt Organizations Act, commonly referred to as "RICO", addresses the infiltration of legitimate businesses by organized crime. Class members seek a remedy for defendants' wrongful conduct, which allegedly depress wages and reduce benefits paid or provided by defendants to US citizens or resident aliens.
