Lawsuit Claims Funeral Home Discriminates Against African Americans

A class action lawsuit alleges that a Mobile County funeral company discriminates against African-Americans. The SLG Group Inc. owns and operates Serenity Funeral Home, Serenity Memorial Garden, Lawn Haven Memorial Gardens and Gulf Coast Vault Co. in Mobile County, Alabama. The lawsuit, filed March 16, alleges that Serenity Funeral Home "attempts to bury only Caucasians in Serenity Memorial Gardens and only African-Americans in Lawn Haven Memorial Gardens."

The lawsuit claims that "almost all of the deceased buried in Serenity are Caucasian. Almost all, if not all, of the deceased buried in Lawn Haven are African-American."

According to the lawsuit, the Mobile Fair Housing Center sent two people - one African-American, the other Caucasian - to Serenity to inquire about burial services.

On Oct. 18, an African-American tester went to Serenity, inquired about a cemetery plot, and was shown plots only at Lawn Haven, the lawsuit states. On Oct. 24, a caucasian tester went to Serenity and asked about burial plots and was onluy shown plots at Serenity Gardens, the lawsuit claims.

A statewide collective action has been filed in Florida against RPN of Florida, Inc. The action is brought on behalf of all current and former employees, who since January 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
A statewide collective action has been filed in New York against Jacobs Nursing & Healthcare Employment Services Agency, Inc. The action is brought on behalf of all New York residents who have been employed by Jacobs between December 22, 1997 and December 22, 2003 and who have not been paid overtime compensation during their employment. The employees bring this action under the federal Fair Labor Standards Act and New York labor laws and seek back pay, statutory damages and injunctive and declaratory relief. As a collective action, all potential claimants must "opt-in" to the action in order to recover. The employees have indicated that the potential class is quite large and have asked the court to issue notice to all potential claimants.
 
A nationwide class action has been filed against Allstate Insurance Company alleging that Allstate's policy of using credit scores as a tool for determining automotive and homeowner insurance policy premiums is discriminatory and violates the civil rights of minority policyholders.
 
A national collective action has been filed in Florida against home loan specialist, Mortgage Investors Corporation. The action is brought on behalf of all current and former Mortgage Investors loan officers who, since June, 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week and/or proper minimum wage for all hours worked. The action is brought under the federal Fair Labor Standards Act and seeks back pay, compensatory, statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
The class has been certified in a lawsuit filed against Zirkle Fruit Company and Selective Employment Agency, Inc., on behalf of legal immigrants who have worked as packing house and orchard laborers for ZIrkle. The action alleges that the companies violated the federal Racketeering and Corrupt Organizations Act by conspiring to hire illegal immigrants who would work at below-prevailing wage standards, in order to force wages down.
