Lawsuit Claims Company Let Consumers Pay for Uneeded Services

A class action lawsuit was recently filed against the nation’s largest tax resolution company, JK Harris & Company LLC, for breach of fiduciary duty and breach of contract including the covenant of good faith and fair dealing. The lawsuit seeks to stop JK Harris & Company from continuing unacceptable business practices.

The action is brought on behalf of all persons or entities that entered into contracts with JK Harris & Company LLC to supply tax services where fees were charged for JK Harris & Company’s Offer In Compromise services.

“JK Harris & Company told our clients they could help them out of an already difficult financial situation,” said the attorney representing the plaintiffs. “Instead they had them pay for services they didn’t need, nor qualify for, ignored their case for almost a year and offered advice which made them incur penalties and interest from the IRS. Consumers deserve better than this." On February 3, 2004, the Internal Revenue Service issued a consumer alert warning taxpayers about businesses claiming that taxdebts can be settled for "pennies on the dollar" through the Offer In Compromise program. According to the Better BusinessBureau (BBB) serving South Carolina, JK Harris & Company LLC has an “unsatisfactory record with the Bureau due to a pattern of complaints.” The BBB processed more than three hundred complaints against JKHC in the past year.

Other Credit / Debt Cases of Interest

A class action has been filed against Experian Information Solutions, Inc., a credit reporting agency, by Steven and Melody Millett after Steven's Social Security number was stolen and used by another individual over the course of 13 years. The Milletts claim that Experian should have known that the Social Security Number was being used by more than one person and that upon being notified of the error, should have corrected their error. The lawsuit alleges negligent misrepresentation, fraud and failure to comply with the Fair Credit Reporting Act and seeks damages and injunctive relief.
 
A statewide class action has been filed in New York against collections specialist, Collection Information Bureau. The action is brought on behalf of all New York consumers who received "form type" collection letters from Collection Information at any time since March 11, 2003. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
 
A national class action has been filed in Pennsylvania against collection specialists, The Enforcer, Inc. The action is brought on behalf of all U.S. residents who have received allegedly misleading collection letters from The Enforcer since April 30, 2003. The action is brought under the federal Fair Debt Collection Practices Act and seeks actual and statutory damages as well as injunctive and declaratory relief.
 
Debt collectors have to abide by very strict rules when they make contact with someone who owes money. The class has been certified in an action filed against Equifax Check Services, Inc. on behalf of persons who have received collection letters from the company for checks that were written on accounts that had insufficient funds. The action alleges that the letters violate the Fair Debt Collection Practices Act by not fully disclosing that the company is a debt collector under federal law.
 
A class action, which apparently covers all U.S. residents, has been filed in Pennsylvania against mortgage giant Chase Manhattan Mortgage. The action is brought on behalf of all consumers who, since 2001, were not furnished with mandatory credit information, or provided with contact information for obtaining this information, after Chase either denied them a mortgage loan or provided one with elevated interest rates or fees. The consumers are seeking compensatory, statutory and punitive damages.
 
Short-term payday loans often unfairly gouge consumers by charging excessive interest rates in the form of "fees." A class action has been filed against numerous payday loan businesses, all of which are owned by Richard D. Clay, II, on behalf of all persons who entered into short-term loan transactions with them, alleging that the businesses violated the federal Racketeer Influenced Corrupt Organizations (RICO) and Truth in Lending Acts, and Georgia's civil and criminal usury statutes, when the businesses charged the consumers excessive interest rates on the loans.
