California Court Reinstates Lead Paint Class Action

A state appeals court in San Jose, California reinstated a class action lawsuit alleging that several paint manufacturers knowingly sold harmful lead-based paint products for decades. The lawsuit was filed by a coalition of cities, counties and school districts that claim they face millions of dollars in costs to remove lead-tainted paint and treat people harmed by exposure. The plaintiffs seek monetary compensation.

The Sixth District Court of Appeal on March 10, 2006 reversed a Santa Clara County Superior Court judge's decision in 2003 to dismiss the lawsuit. The three-judge appeals panel said the lower court ruling was erroneous regarding allegations of public nuisance, liability, negligence and fraud.

The defendants include the Lead Industries Association, Atlantic Richfield Co., American Cyanamid Co., Conagra Grocer Products Co., E.I. DuPont, O'Brien Corp. and Sherwin-Williams Co.

A class action has been filed against New York City Health and Hospital Corporation for retaliation and violations of overtime laws. The complaint alleges that Marjorie Barnwell worked for Kings County Hospital, but was not paid for overtime and that the Hospital retaliated against her when she confronted them. Barnwell is suing for unpaid overtime compensation and retaliation.
 
Southern California Superior Court Judge David Velasquez granted class action certification to a lawsuit filed by three former Verizon telephone directory advertising sales representatives claiming the company unlawfully deducted corporate business losses from their wages between 2000 and 2005.
 
A statewide collective action has been filed in New York against the City of Newburgh. The action is brought on behalf of all current and former employees of the Newburgh Police Department who were not paid overtime compensation since December 31, 2000. The action is brought under the federal Fair Labor Standards Act and seeks back pay, statutory damages and liquidated damages as well as injunctive and declaratory relief. As a collective action, all potential claimants must "opt-in" to the case in order to be considered part of the class. The employees have requested that the court issue notice to all potential claimants.
 
An $18+ million class action has been filed against the Mayo Foundation and its subsidiary clinics in Arizona, Minnesota, and Florida on behalf of employees who allege that the health provider's method for paying salaried workers shorts employees while netting the company millions of dollars in violation of state labor laws.
 
On October 6, 2005, a U.S. District Court judge refused to temporarily freeze funds the teachers union seized from teachers statewide without due process in order to fight Gov. Arnold Schwarzenegger and several measures on the November 8 special-election ballot. Since September 30, 2005, the California Teachers Association "CTA" has been automatically collecting an additional $60 a year in dues from all 335,000 teachers and college professors statewide. Six teachers, represented by the National Right to Work Legal Foundation, filed a class-action lawsuit against the union in late August, citing a 1986 U.S. Supreme Court decision that says all union members must be notified of how their forced union dues are spent and be given a chance to prevent their money being spent for purposes other than collective bargaining.
 
Orange County Sheriff Kevin Beary faces a class-action lawsuit filed by agency retirees angered by losing lifetime health insurance benefits. About 300 former employees claim Beary illegally stripped them of the coverage offered since 1998 to anyone who worked 20 years or more for the agency.
