Univesity of Rochester, New York Settles Class Action Lawsuit

After taking over a year, the University of Rochester settled one of the largest class action suits in the country. Employees claim the University never paid for overtime worked. "Under the University's policy, people would work through lunch, but every week the University would automatically take off a half hour for lunch each day, so some employees would have gotten their lunches, but some employees would have worked for some or all their lunch period and it was still deducted," said the attorney representing the workers.

Under the settlement, up to 40,000 hourly workers will receive a maximum of $100 for each year worked up to 7 years. The suit affects those employed under the University and its affiliates from February 1999 through December 2005.

The tentative suit is awaiting approval from the court. If approved, workers can expect to see a check by fall 2006.

Laborers employed by Terminix International Company have filed a class action lawsuit against the nationwide extermination service and its parent company, Servicemaster. The lawsuit claims that the defendants require employees to work hours in excess of 40 per week without receiving overtime. The complaint alleges that this denial of overtime violates the federal Fair Labor Standards Act. The plaintiffs seek an award of the unpaid overtime together with interest, costs and other damages.

The parties have reached a tentative $1.9+ million settlement in an action filed against Kash n' Karry Food Stores, Inc. on behalf of all current and former female management and non-management associates of the company who worked at any time between June 10, 1999, and August 22, 2003, in Kash n' Karry's retail operations and completed their 90-day probationary period on or before August 22, 2003. Claims must be postmarked no later than November 21, 2003, to be considered valid.
