Judge Grants Class Action Status to Bridge Terminal Transport Lawsuit

A federal judge in New Jersey granted class-action status to a lawsuit filed by the Owner-Operator Independent Drivers Association (OOIDA) and seven drivers against one of the largest transportation companies in the world. OOIDA, along with seven of its owner-operator members serving as co-plaintiffs, filed suit against Bridge Terminal Transport (BTT).

Dennis Cavanaugh of the U.S. District Court for the District of New Jersey ruled that OOIDA met all the conditions for the case to be vertified as a class action.

OOIDA alleges that BTT violated federal truth-in-leasing regulations by failing to disclose or properly document compensation provisions in its lease agreements. OOIDA also accuses BTT of illegally charging truckers for fuel and fuel-related transaction fees and illegally charging truckers for insurance-related administration fees.

The class could include as many as 6,000 current and former drivers who have had lease agreements with BTT since June 2000.

A federal judge ordered AK Steel Corporation to pay at least $46.2 million to 1,250 former employees in a class action lawsuit over pension benefits. The 2002 lawsuit charged that the company had miscalculated the lump sum pension payment for participants in one of its pension plans. The plaintiffs claimed the method used to calculate the payments does not comply with federal law and resulted in underpayments.
 
Decker College in Louisville, Kentucky, already under federal and state investigation, has been sued by a laid-off financial aid officer who says the school owes her $2,000 for work performed and benefits and who is seeking class-action status for her lawsuit.
 
A class action lawsuit has been filed in the Northern District Court of Illinois against Abbott Laboratories and Hospira, Inc. for violations of the employee retirement income security act (ERISA).
 
A class action lawsuit has been filed in the Southern District Court of Florida against Choice Environmental Services of Miami, Inc. The case involves violations of the Fair Labor Standards Act. No additional information about the substance of the allegations is available at this time. The federal Fair Standards Labor Act and similar state labor laws require that most hourly employees be paid overtime wages if they work more than 40 hours in a normal workweek. Two related class actions have been filed against home improvement center operator Lowe's Companies, Inc., and certain of the company's subsidiaries on behalf of current and former employees who allege that the companies did not properly calculate their overtime pay, in violation of state and federal labor laws. Qualified employees should join the action as soon as possible to prevent forfeiture of benefits because of the operation of federal statutory deadlines.
