McDonald's Sued over French Fry Ingredients

McDonald's faces multiple lawsuits that each claim the fast-food giant misled the public after it acknowledged that its french fries contain milk and wheat ingredients. One lawsuit, filed in Cook County Circuit Court in Illinois, alleges McDonald's falsely advertised that it was safe for people with dietary issues relating to the consumption of dairy items and wheat allergens to eat McDonald's french fries because they were gluten- and milk-free.

Debra Moffatt of Lombard, Ill., seeks unspecified damages in a suit filed in Chicago. Her attorney said his client has celiac disease, which causes gastrointestinal symptoms set off by eating gluten, a protein found in wheat.

Additionally, Mark and Theresa Chimiak of Jupiter, Fla., filed a lawsuit in Florida, claiming their 5-year-old daughter has an intolerance to gluten and became seriously ill after eating the fries. Furthermore, Nadia Sugich of Los Angeles sued, saying she does not eat any animal products and would not have eaten the fries had she known they contained dairy ingredients.

The lawsuit filed in Cook County Circuit Court seeks class-action status, an unspecified amount in damages and an injunction against McDonald's prohibiting the corporation from representing that its fries are gluten- and milk-free.

Other Consumer Products Cases of Interest

The Illinois Appellate Court has upheld a ruling favorable to the plaintiffs in a class action filed against Blockbuster Entertainment, Inc., on behalf of persons who have been charged excessive fees after April 1, 2001, when they failed to return videos, returned them in damaged condition, or returned videos past their due date.
 
Multiple class actions have been filed in various states against the Toyobo Company, LTD. and Second Chance Body Armor, Inc. The action is brought on behalf of all U.S. residents who purchased bullet proof vests from Second Chance which contained Zylon, a fiber manufactured by Toyobo. The purchasers allege that vests which contain Zylon are defective and degrade over time, rendering them not usable for their intended purpose. Purchasers are seeking compensatory and punitive damages as well as injunctive and declaratory relief.
 
A class action has been filed on behalf of consumers who purchased the “Thinking 21C” program from education and consulting services provider/retailer Stratia Group. The complaint alleges that Stratia claimed that “Thinking 21C”, a collection of DVD’s and associated counseling services, would “open the eyes of purchasers to the way the world really works”. The program promised to reveal “intricacies and loopholes” that purchasers could use to eliminate debt and increase wealth. Plaintiffs contend that in fact, after purchasing the program, Stratia provided bogus and fraudulent debt counseling services that had the effect of dramatically worsening the plaintiff’s debt and credit problems. Plaintiffs seek damages of 2.25 million per count in the eight count complaint, together with treble punitive damages.
 
On April 16, 2002, Ames True Temper, Inc. recalled about 650,000 wheelbarrows as a result of possible issues with plastic assemblies and rims. When filled with compressed air, the plastic wheelbarrow rims may break or even explode. This can cause plastic shards from the explosion to fly out possibly injuring consumers.
 
A statewide class action has been filed in Florida against Sears Home Improvement Services, Inc. The action is brought on behalf of all Florida residents who, since April 1999, have had vinyl siding installed by Sears on their home. The action alleges that Sears has violated Florida's Deceptive and Unfair Trade Practices Act by overestimating the amount of materials required for the installation job and then not crediting the purchasers for any unused material that was not in the estimate. The purchasers are seeking unspecified compensatory damages a well as injunctive and declaratory relief.
 
Lawyers filed a a class action lawsuit against the operators of an alleged pyramid scheme in Louisville, Kentucky. The Phoenix Group and Eli Ohayon are named as defendants.
