Civil Rights Sue Over Governments Alleged Surveillance

A civil liberties group sued AT&T Inc. for its alleged role in helping the National Security Agency spy on the phone calls and other communications of U.S. citizens without warrants. The class action lawsuit, filed in U.S. District Court in San Francisco by the Electronic Frontier Foundation, seeks to stop the surveillance program that started shortly after the 2001 terrorist attacks. It also seeks billions of dollars in damages.

The EFF claims the San Antonio-based telecommunications company not only provided direct access to its network that carries voice and data but also to its massive databases of stored telephone and Internet records that are updated constantly.

"Our main goal is to stop this invasion of privacy, prevent it from occurring again and make sure AT&T and all the other carriers understand there are going to be legal and economic consequences when they fail to follow the law," said an EFF staff attorney.

In its lawsuit, the EFF claims AT&T violated U.S. law and the privacy of its customers as part of the "massive and illegal program to wiretap and data-mine Americans' communications." The group said it identified AT&T through news reports and its own investigation.

Other Civil Rights Cases of Interest

Trucking has always been regarded as a predominantly male occupation, but women employed at trucking giant CH Robinson Worldwide claim that the company and it's male employees created an environment that crossed the legal boundary into active discrimination. A class action lawsuit filed against the company alleges that women were not paid as well or promoted to supervisory jobs as often as men, even though they were equally qualified. The suit also contends that the work environment at CH Robinson was extremely hostile to women as a result of lewd behavior on the part of male employees, including branch managers. A hearing on class certification in this gender discrimination suit was held in late November, 2004. At this time of this report a ruling had not yet been issued. If the class is certified as many as 2,000 current and former sales, operation and support workers would be able to sue the Minnesota based company.
 
Circuit Judge Jeffrey Streitfeld allowed a class action lawsuit to go forward alleging that the Broward Sheriff's Office has been conducting illegal strip-searches of people arrested for relatively minor crimes. The lawsuit charges that the Sheriff's Office "instituted a policy to strip-search all pre-trial detainees, including those arrested for traffic offenses and misdemeanors."
 
A statewide collective action has been filed in Florida against Running Billboard Corporation. The action is brought on behalf of all current and former hourly employees who were not paid overtime compensation by Running Billboard. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as injunctive and declaratory relief. As a collective action, all potential claimants are required to "opt-in" to the case in order to be considered part of the class. The employees have asked the court to issue notice to all potential class members.
 
A statewide class action has been filed in California against collection specialist, Bridgeport Financial, Inc. The action is brought on behalf of all California consumers who have received collection letters from Bridgeport that required them to dispute the validity of the debt under collection in writing only. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
 
A statewide class action has been filed in Indiana against attorney Lawrence Reuben and the Law Offices of Lawrence Reuben. The action is brought on behalf of all Indiana consumers who, since January 21, 2003, have received a collection letter from Reuben or his law office which did not include the federally mandated language regarding consumers' rights to dispute the validity of the debt being collected. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
 
A class action has been filed against Florida’s Miami-Dade County and several county corrections officials on behalf of women who allege that their constitutional rights were violated when they were strip-searched without cause.
