Three Smokers File Lawsuit Over State's Per-Pack-Fee |

Three smokers who pay Minnesota's 75-cent-per-pack "health impact fee" that a judge has declared illegal want their money back. The smokers filed a lawsuit that seeks class action status on behalf of all the state's smokers.
The plaintiffs so far are a Stillwater woman and men from Maple Grove and St. Paul.
The new lawsuit, filed in Hennepin County Minnesota, claims that ordinary smokers "ultimately bore the economic burden" of the fee because tobacco distributors passed on the extra cost on to consumers, so they should get any refund. It says the 14 defendants, including tobacco manufacturers and wholesalers, aren't entitled to keep the bonus.
The state is still collecting about $20 million a month but is required to bank the money while the case is pending.

Lawyers filed a a class action lawsuit against the operators of an alleged pyramid scheme in Louisville, Kentucky. The Phoenix Group and Eli Ohayon are named as defendants. Microsoft is facing a class action suit over a tool that gathers data on a user’s computer in an effort to detect bootlegged copies of its Windows operating system. The suit was filed in U.S. District Court in Seattle, concerns Microsoft’s Windows Genuine Advantage (WGA), an antipiracy tool the company introduced in July 2005. The WGA program collects hardware and software data, delivering it to Microsoft servers. The stored information is then used to warn of possible piracy violations.
A national class action has been filed in Florida against wireless service giant, Sprint PCS. The action is brought on behalf of all U.S. residents who have either been charged an early termination fee for canceling their Sprint PCS service, or who have been forced to maintain their Sprint PCS service in order to avoid early termination fees. The Sprint users allege that Sprint has breached its contract with customers by not providing adequate service and by not investigating problems with service sufficiently. The action is brought under state contract law and state laws regulating unfair and deceptive business practices and seeks compensatory and punitive damages as well as disgorgement of profits and injunctive and declaratory relief. A class action lawsuit has been filed in the Southern District Court of Florida against Dinosaur Tire & Performance Center, Inc. The case involves violations of the Fair Labor Standards Act.
