Lawsuit Against Union Claims Unfair Practices

Five North Carolina employees of commercial truckmaker Freightliner have filed a federal lawsuit against the United Auto Workers (U-A-W).

The lawsuit alleges that union officials and company managers agreed to wage and benefit cuts at nonunion plants in North Carolina in 2002 in exchange for valuable company assistance in organizing the workers. The National Right to Work Foundation says the law bars employers from delivering "things of value" to unions.

"To get help in coercing thousands of workers into union ranks and to obtain at least $1 million in annual dues revenues, UAW officials sold out the very workers they sought to represent," said a vice president of the foundation.

The lawsuit seeks class-action status. It claims both the U-A-W and the Oregon-based Freightliner violated the Racketeer Influenced and Corrupt Practice Act.

A class action has been filed against Onyx Waste Services, Inc., a Wisconsin based company that operates a trash removal company in Florida, for failure to pay overtime wages in violation of the Fair Labor Standard Act (FLSA).
 
A statewide collective action has been filed in Florida against hotel giant, Fairfield Resorts, Inc. The action is brought on behalf of all current and former hourly employees of Fairfield Resorts, who since June 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
A class action has been filed against New York City Health and Hospital Corporation for retaliation and violations of overtime laws. The complaint alleges that Marjorie Barnwell worked for Kings County Hospital, but was not paid for overtime and that the Hospital retaliated against her when she confronted them. Barnwell is suing for unpaid overtime compensation and retaliation.
 
A Los Angeles Superior Court Judge granted preliminary approval to a $5,348,000 settlement of class action litigation. Finding the proposed settlement to be fair and reasonable, the order deals with disputed payroll practices in the entertainment industry in California.
