Run Flat Tires Lead to Class Action Lawsuit

Two Michigan men are suing a maker of tires for recreational vehicles they say are defective and pose a safety risk. Jeffrey Hunsaker, of Byron Center, and Dennis Drooger, of Holland, filed the suit against Aiken, S.C.-based Carlisle Tire & Wheel Co. last January in Kalamazoo. Their lawyers asked U.S. District Judge Richard Enslen for class-action status to allow them to open the lawsuit to Carlisle tire owners as far back as 1999.

The defective tires "impose economic losses on consumers, cause other property damage to their vehicles, and create a major inconvenience to recreational travelers," the plaintiffs' lawyer, argued in a court filing. "Worse yet, the Carlisle tires at issue also present a significant safety risk."

The parties have reached a settlement apparently valued at $6.5 million in a 38-state action filed against Ford Motor Credit Corporation on behalf of Ford and Lincoln Mercury “Red Carpet” lease customers who allege that the company overcharged them for early lease termination fees between 1991 and 1995. The parties have reached a final settlement apparently valued at $3 million in an action filed against Safeco Insurance Company of America and related companies on behalf of Montana customers who filed uninsured, underinsured and medical claims against the company from 1996 to the present. The action alleged that state insurance provisions prohibiting "stacking'' of multiple insurance policies were unenforceable. Persons eligible to participate in the settlement should contact attorneys for the class for more information as soon as possible.
 
A class action has been filed against Motiva Enterprises, LLC, and Shell Oil Company on behalf of all persons who purchased sulfur-tainted gasoline from New Orleans-area gas stations that were supplied by Motiva during May 2004. The action seeks compensatory damages to pay for vehicle repair and customer inconvenience.
 
Several class actions have been filed against financial services company Washington Mutual, Inc., (NYSE: WM) and certain of its officers and directors by stockholders who purchased the company's common stock between April 15, 2003, and June 28, 2004. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
Three lawsuits have been filed in Superior Court by Formula One fans angry over the decision to run the U.S. Grand Prix with only six cars.
 
Uninsured/underinsured motorist automobile insurance covers you if you are injured in an accident by a liable party who carries insufficient (or no) liability insurance. The parties have reached a tentative $2 million settlement in an action filed against Nationwide Mutual Fire Insurance Company and related companies on behalf of California policyholders who were sent a selection/rejection form by the company and had their uninsured motorist coverage limits raised unilaterally by the company above $30,000/$60,000 and paid for the coverage between January 1, 1994, and December 31, 2002. Claim forms must be postmarked by October 22, 2003, to be considered valid.
