Lawsuit Filed Against First Horizon Mortgage

A lawsuit filed against First Horizon Mortgage Corporation over overtime pay owed mortgage lenders was certified as a class action by a judge in Kansas.

Seven loan officers for First Horizon in Johnson County, Kan., had filed suit in U.S. District Court Kansas City, Kansas in October, claiming the company failed to pay them for overtime they worked.

"The suit covers about 2,200 workers" said the lawyer handling the case. In Memphis, that includes about 100 national sales support officers and 15 to 20 loan officers in three branches.

The suit and amended complaint states the loan officers worked far more than 40 hours a week, coming in early, leaving late and working on weekends. The company never had them record working hours until after the suit was filed and that they were paid only by commission, never receiving overtime, the documents said.

The action is similar to suits filed against other mortgage companies nationwide during the past six years, he said.

A class action lawsuit has been filed in the Southern District Court of Florida against Recreation Foodservices Management, Inc. The case involves violations of the Fair Labor Standards Act. No additional information about the substance of the allegations is available at this time. A class action has been filed against McDonald's Corporation alleging that the fast food giant has been systematically terminating employees over the age of 40 in its Atlanta region restaurants. The former employees are seeking back pay, reinstatement to their positions, liquidated damages equal to their back pay and lost wages, injunctive and declaratory relief, attorney's fees, costs and interest.
 
Just because you are classified as a managerial worker does not mean that you might not qualify for overtime pay. The parties have reached a tentative $3.5 million settlement in an action filed against Borders, Inc. (apparently the proper defendant should have been the Borders Group, Inc.) on behalf of assistant managers who worked in California Borders Bookstores between April 10, 1996, and March 18, 2001. A statewide collective action has been filed in Florida against Seaspecialties, Inc. The action is brought on behalf of all current and former employees, who since January, 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
