Court Approves $2M Settlement in Abercrombie & Fitch Overtime Lawsuit |

More than 250 managers who worked for Abercrombie & Fitch stores across California between July 10, 1998, and April 30, 2004, will share in a $2 million settlement approved by Los Angeles Superior Court Judge Kenneth R. Freeman. The case was filed in July 2002, and the class was certified on September 14, 2004.
The complaint charged that Abercrombie improperly classified its Store Managers as exempt to avoid paying overtime, even though their duties entitle them to overtime pay. "For many of these managers, this was their first job. Some didn't know they were entitled to overtime and others were too afraid of losing their first job to speak up. Abercrombie took advantage and made its managers do the same job as hourly sales clerks who are paid overtime. But the managers received no extra compensation although they worked well over 8 hours a day and 40 hours a week," stated a lawyer for the plaintiffs.

The federal Fair Standards Labor Act requires that most hourly employees be paid overtime wages if they work more than 40 hours in a normal workweek. A nationwide class action has been filed against drugstore chain operator CVS RX Services, Inc., on behalf of current and former pharmacist employees who allege that the company has not paid them overtime for hours they work in excess of their normal 40-hour workweek, in violation of the Fair Labor Standards Act. Qualified employees should join the action as soon as possible to prevent forfeiture of benefits because of the operation of federal statutory deadlines.
The issue of corporate health plan prescription contraceptive coverage is growing quickly. A class action has been filed against DaimlerChrysler Corporation on behalf of women employees who allege that the company discriminated against them by failing to include prescription contraceptives in its health plan coverage in violation of federal civil rights laws.
A statewide collective action has been filed in Florida against HospiceCare of Southeast Florida, Inc. and Susan Telli, executive director of HospiceCare. The action is brought on behalf of all Florida residents who are either currently, or have been since January 5, 2001, employed by HospiceCare and were not paid overtime compensation. The action is brought under the federal Fair Labor Standards Act and seeks statutory, compensatory and liquidated damages as well as injunctive and declaratory relief. As a collective action, all potential claimants must voluntarily "opt-in" to the case in order to be considered part of the class. The employees have requested that the court issue notice to all potential claimants in this case. California's labor laws are more protective of its workers than are most states'. The class has been certified in a class action filed against finance newspaper Investor's Business Daily, Inc., and three related companies on behalf of current and former inside telephone sales marketing agents/associates who sell newspaper subscriptions from a California-based telemarketing center. The action alleges that Investor's Business Daily compels them to return commissions on failed subscriptions and also fails to pay them overtime in violation of California unfair business practices and labor laws. Retirement plans are often so confusing that it seems like you need to be an accountant to understand them. On July 31, 2003, the trial court ruled in favor of the employees in a class action against IBM Corporation and the IBM Pension Plan on behalf of certain employees who allege that the company's changeover from a traditional retirement plan to a newer cash balance plan has cheated them out of part of their retirement. Benefits will not be available to class members until all possible appeals have been exausted.
A class action lawsuit has been filed in the Southern District Court of Texas against Agape Manor Homes, Inc. The case involves violations of the Fair Labor Standards Act which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments.
