Orange County, Florida Sheriff Faces Class Action Lawsuit |

Orange County Sheriff Kevin Beary faces a class-action lawsuit filed by agency retirees angered by losing lifetime health insurance benefits. About 300 former employees claim Beary illegally stripped them of the coverage offered since 1998 to anyone who worked 20 years or more for the agency.
"These retirees depended on this benefit to survive," Kevin Carlucci, a deputy and president of Fraternal Order of Police Lodge 93, said when the lawsuit was filed at the Orange County Courthouse.
Free coverage ended in October after the county Commission learned Beary granted it seven years ago without telling the government responsible for funding the costly bonus.
A Beary spokesman said the county tax base simply cannot support free retirement healthcare costs.

The case applies to workers who have been employed by C & S since 2000. A class action lawsuit has been filed in the Northern District Court of Illinois against Frank Zanotti Title Company, Inc. The case involves violations of the Fair Labor Standards Act. No additional information about the substance of the allegations is available at this time. California law makes it illegal for companies to take away, or "charge back" an employee's commissions in certain circumstances. A class action has been filed against Airtouch Cellular of California, Verizon Wireless Services, LLC, and Cellco Partnership on behalf of current and former Verizon sales employees who have worked in a California-based telemarketing center or retail outlet, alleging that the company compels them to return commissions on failed wireless subscriptions and also fails to calculate overtime pay properly, in violation of California unfair business practices and labor laws.
A statewide collective action has been filed in Florida against Spring Park Drug, Inc. The action is brought on behalf of all current and former employees, who since February 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members. A class action has been filed against The Great Atlantic & Pacific Tea Company, Inc., on behalf of current and former employees of A&P, The Food Emporium, and Waldbaum’s, who allege that the supermarket chains fail to pay them overtime wages, and deleted hours actually worked from time records, in violation of New York labor law. Former workers of Havens Steel Company reached a preliminary settlement in a lawsuit filed over a dispute of an employee stock ownership plan. The proposed settlement of the class-action suit, which includes about 500 former employees and retirees, canceled a trial that was scheduled to begin early April 2006.
