Ford has settled a class-action lawsuit over the troublesome plastic intake manifolds on certain Ford and Lincoln-Mercury models from the 1996 through 2002 model years. The settlement was reached in June but needed final approval by the court.
Owners who have already replaced the manifolds will receive full reimbursement. Owners without a receipt will receive $735 for repairs, according to attorneys handling the case. The company is also extending the new-vehicle warranty on the nylon composite part to seven years to cover vehicle owners who haven't yet replaced the manifold. The class-action lawsuit covers about 1.8 million vehicle owners. The settlement is expected to cost Ford more than $100 million. Vehicles included in the settlement are the Ford Crown Victoria, Mercury Grand Marquis and Lincoln Town Car from the 1996-2001 model years; 1997 Mercury Cougar, Ford Thunderbird and Ford Mustang; some Mustangs from 1998-2001; and some Ford Explorers from 2002. Plaintiffs in the case claimed the intake manifolds are prone to premature cracking, which could lead to coolant leakage and expensive damage to the engine. Other Automotive Cases of Interest If a fee is properly paid by a business owner, it may be wrong for the business to pass that fee on to consumers. The class has been certified in an action filed against 636 Texas auto dealerships on behalf of certain car buyers who purchased cars after September 1, 1995, and were forced to pay "dealers inventory tax" to the dealerships in violation of the Texas Deceptive Trade Practices Act. The action seeks unspecified compensatory and punitive damages.
A national class action has been filed in Illinois against the General Motors Corporation and the Goodyear Tire and Rubber Company. The action is brought on behalf of all U.S. residents who purchased Chevrolet Corvette automobiles manufactured between 1994 and 2004. The Corvette owners claim that the Goodyear tires that came as standard equipment on their automobiles were defective because they allegedly failed at approximately 12,000 miles and were not covered under warranty. The Corvette owners claim that GM and Goodyear's conduct amounts to consumer fraud and fraud by omission and are seeking the replacement cost of the tires as well as damages for inconvenience and injunctive and declaratory relief.
A California statewide notice program authorized by California's Sacramento County Superior Court began to issue notices to those who bought, owned or leased 1991-2001 model year Ford Explorers. A class action has been filed against BMW of North America, LLC, on behalf of thousands of 2001-2004 BMW X5 owners nationwide, who allege that the sport utility vehicles have defective air bags which can deploy for no reason, and that the company requires owners to sign confidentiality agreements before performing free repairs. The suit further claims that the confidentiality form violates Florida's 1990 Sunshine in Litigation Act barring secrecy about public hazards. A class action has been filed against the Banc One Acceptance Corporation on behalf of all Florida residents who leased cars from Banc One between October 16, 1998, and October 16, 2003, and who paid "taxes" on itemized fees for wear and tear, excessive mileage and disposition of the vehicles at the end of their lease. The lessees claim that these "taxes" were merely hidden fees and that Banc One either pocketed the "tax" money, or benefited from it prior to forwarding it to the Department of Revenue.
The class has been certified in a nationwide action filed against DaimlerChrysler Corporation on behalf of all owners of 1996 and 1997 Chrysler Town & Country’s, Chrysler Minivans, Plymouth Voyagers, Plymouth Grand Voyagers, and Dodge Caravans, who allege that the front-passenger airbags in these vehicles deploy with excessive force in low-speed accidents, possibly injuring children or small adult passengers. |
