Guitar Center Agrees to Settle Lawsuits

Music retailer Guitar Center Inc. has reached a preliminary agreement to settle two purported class action lawsuits filed by hourly store employees in California.

The suits alleged, among other things, that the company improperly documented and enforced break-time and lunchtime periods for the workers.

Guitar Center said it denies all liability or wrongdoing in the cases but chose to settle to avoid the distraction and costs it would otherwise incur.

Under the terms of the proposed settlement, Guitar Center will make cash payments of up to $3.5 million to resolve the claims, which includes payments to class members

The settlement is subject to final documenation and court approval.

Grocery chain Smart & Final reached a tentative $19 million agreement in a class-action lawsuit claiming employees were not properly paid. The employees alleged the Los Angeles-based chain failed to properly calculate overtime pay and also neglected to pay for all hours worked. The suit also alleged other compensation was not paid.
 
Anticompetitive action by powerful companies hurts other businesses as well as individual consumers. A class action has been certified against 15 major U.S. and foreign airlines on behalf of all travel agents in the United States, Puerto Rico, and the United States Virgin Islands, who issued tickets, miscellaneous charge orders, or prepaid ticket advances between October 1, 1997, and the eventual date of any judgment in the action.

A class action has been filed against Elli's Associates for violations of the Fair Labor Standards Act (FLSA) and the New York Minimum Wage Act, specifically for the failure to pay overtime to its employees. The class seeks their unpaid regular wages, unpaid overtime compensation, an additional 25 percent as liquidated damages, reasonable attorneys' fees and costs of the action.
 
A statewide collective action has been filed in Florida against J&B Today's, Inc. The action is brought on behalf of all current and former hourly employees of all Florida J&B Today's stores, who since May 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
