West Virginia University Reaches Settlement in Asbestos Suit

West Virginia University reached a settlement in a class-action lawsuit affecting up to 5,600 former and current employees who may have been exposed to asbestos, the school announced. As part of the proposed settlement, WVU will institute and pay for a medical surveillance program to be conducted for 20 years. WVU also agreed to pay $1 million to cover potential claims and attorney fees.

University employees sued in 2000 and sought medical monitoring for potential asbestos-related health problems as a result of working in university buildings containing asbestos insulation.

The workers, including professors, custodians, secretaries and other staff, alleged that asbestos in campus buildings put them at an increased risk of cancer.

The university said in a statement that the agreement had been reached in the "spirit of compromise."

"WVU maintains that all standard, recognized practices for asbestos removal have been followed over the years, and that the general population of employees, through routine monitoring of buildings and air samplings, remain safe from any harmful effects of asbestos-containing materials," the university said.

A judge must approve the agreement before it becomes final. A hearing is scheduled for Dec. 22, 2006.

Lead-containing paints have been banned by the U.S. Environmental Protection Agency since 1978. A class action has been filed against the Louisville, Kentucky, Housing Authority on behalf of children who were allegedly exposed to toxic levels of lead when they played on soil that the Authority knew was polluted, in violation of state and federal environmental laws.
 
The lawsuit claims the city of Sioux Falls negligently designed, constructed, maintained and inspected its sanitary and storm sewer lines and systems. Due to those faults, homeowners say the city should pay for damages cause by flooding during two storms in Summer 2004.
 
The parties have reached a tentative $65 million settlement in an action filed against Union Pacific Corporation on behalf of thousands of evacuees who were forced to leave their homes in Eunice, Louisiana, after a train derailment on May 27, 2000. Persons eligible to take part in the settlement should contact attorneys for the class for more information.
