A West Virginia woman has filed a class action lawsuit against Capital One Bank, accusing the company of violating the Fair Debt Collection Practices Act.
Earlene West of Gandeeville filed the lawsuit on Nov. 16 in U.S. District Court. In her lawsuit, she alleges that Capital One acquired several charged-off credit card accounts from Providian, including her own.
West also claims that her account had been previously settled with a debt collector hired by Providian.
Still, West said she received numerous letters and telephone calls from Capital One and its collector to settle the debt despite having documentation to show it had been paid.
The lawsuit claims West's repeated written and oral requests for Capital One to stop contacting her were ignored.
"This is a case where (West) played by the very rules laid down in favor of the credit card companies, but was still forced to endure harassing phone calls and letters," said one of West's attorneys.
As many as 100 consumers are potential members of the class, according to the lawsuit.
