Tanker Leak in Cincinnati Leads to Lawsuits

Two class action lawsuits were filed relating to a CSX Transportation tanker car leak that forced evacuations in Cincinnati.

The lawyers representing homeowners filed the lawsuit against CSX Transportation and the railcar's owner, Westlake Styrene Company.

The police evacuated parts of Cincinnati affected by the gas leak.

The lawsuit seeks "injunctive relief requiring Defendants to perform such investigations, studies, analyses, medical tests, and remedial measures as are necessary, just and proper under the circumstances" and at least $25,000 in compensatory and punitive damages.

The suits accuses the companies of negligence and seek compensatory and punitive damages.

Two days after the discovery of the leak, Mayor Luken declared a state of emergency in order to enable the curfew, which was aimed at preventing possible looting in the area.

Coles' filed a lawsuit against the DuPont Co. that targets the company's releases of a chemical used to make nonstick and stain-resistant products.
 
When tires burn, they can pollute as bad as or worse than an oil well fire. In May 2003 the court granted final approval to a $9 million partial settlement with one of the defendants, CMS Generation Company, in a class action on behalf of some 10,000 persons who were residents of Stanislaus County, California, in 1999 and victims of the pollution that resulted when a massive tire dump burned near Westley, California. The deadline for filing claims under the settlement is unavailable.
