A Missouri circuit court judge gave class-action status to about 250,000 current and former Wal-Mart workers in the state who are challenging some of the company's practices.
The employees claim that the company forces them to work without pay and miss promised breaks in an effort to avoid paying them overtime, said the lawyer handling the case. The suit accuses Wal-Mart of forcing hourly employees to work off the clock, failing to pay them overtime, and preventing them from taking breaks. Judge Sandra Midkiff did not set a trial date. The class includes up to 200-thousand people who worked in Missouri at Wal-Mart Discount and Supercenters stores, as well as Sam's Club stores. The 2001 suit spans a nearly seven-year period ending June 30th, 2003.

A class action lawsuit has been filed in the Middle District Court of Florida against Ranger American of Florida, Inc. for violations of the Fair Labor Standards Act (FLSA). Class members seek damages and reasonable attorney's fees and costs of the litigation. A national collective action has been filed in Florida against home loan specialist, Mortgage Investors Corporation. The action is brought on behalf of all current and former Mortgage Investors loan officers who, since June, 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week and/or proper minimum wage for all hours worked. The action is brought under the federal Fair Labor Standards Act and seeks back pay, compensatory, statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members. A class action immigration lawsuit has been filed against Cafe Express, its parent company Wendy's International, Inc. and its former law firm on behalf of nearly 100 undocumented employees who were recently fired. |
