Landstar Appeals Lawsuit Certification

Landstar will appeal a U.S. District Court ruling certifying a class action in a lawsuit over Landstar’s owner-operator contracts.

The Owner-Operator Independent Drivers Association and four owner-operators have sued Landstar, alleging that the fleet’s contractual agreements with its independent owner-operators do not meet federal disclosure requirements.

OOIDA claims that Landstar overcharged owner-operators for fuel and fuel-related transaction fees, failed to disclose and deduct amounts related to military shipments, and overcharged for base plates and permits issued by the states.

Certification as a class action opens the door to more plaintiffs joining the suit and allows a single ruling to bind all the parties. U.S. law requires all plaintiffs in a class action to be “similarly situated,” meaning likewise affected by a defendant’s actions.

Landstar believes that “individual contractor-specific issues predominate over common issues, and will therefore ask the U.S. Court of Appeals in Atlanta to overturn this ruling,” said Landstar vice president. The District Court ruling itself acknowledged that “the issue of damages will be unique and subject to individualized proof."

The appeal was not unexpected, said OOIDA executive vice president. “One of the defense strategies in cases like this is to try and run the other side out of money”.

For an individual trucker to file such a suit against Landstar would be almost impossible, the plaintiffs' attorney said, arguing that an individual would have neither the time nor the money. “It is for that very reason that these particular cases have to be class actions,” he said.

To recover under the settlement, a completed proof of claim postmarked no later than January 9, 2004, must be mailed to the claims administrator.
 
Toyota Motor Sales U.S.A. Inc. quietly settled a class-action lawsuit that covers about 3.5 million Toyota and Lexus vehicles that may have been damaged by engine oil sludge.
 
A group of 140 plaintiffs is suing Ford, GM, Wal-Mart, Sam's Club, AutoZone, and Advance Auto Parts. The plaintiffs are seeking a court ruling to be able to use the "product lines" they purchased as their proof of the required "product markets" in their antitrust suit for illegal price discrimination brought under the 1936 Federal Robinson-Patman Act.
 
DaimlerChrysler's North American financing arm has tentatively settled class-action lawsuits brought by minority customers in Chicago and New Jersey. The plaintiffs, mainly composed of African Americans and Hispanics, allege DaimlerChrysler discriminated against in their attempts to purchase new vehicles.

A class action has been filed against Nissan Motor Acceptance Corporation on behalf of Californians who had auto loans with the company and had their autos repossessed and sold at auction, leaving them with deficiency judgments to pay even though they lost the auto.
