$6 Million Settlement in Cincinnati Bell Lawsuit

Judge Robert Ruehlman approved a class-action settlement against Cincinnati Bell Wireless for improper roaming charges.

The settlement for more than $6 million will allow subscribers who were wrongfully charged for roaming services to get up to $50 in vouchers for certain Cincinnati Bell services.

The settlement also allows customers who can demonstrate that they had been wrongfully billed roaming charges in excess of $100 to receive up to half of the money they paid in cash, instead of the $50 voucher.

On November 5, 2003, the court granted final approval to the parties' $12+ million settlement in a nationwide action filed against Nestle Waters North America, Inc., which does business under the name Poland Spring Water Company, on behalf of all persons who have purchased Poland Spring brand bottled water since January 1, 1996. Class action lawsuit was filed by th Arizona Center for Disability Law Center against the Arizona Health Care Cost Containment System (AHCCCS), (Arizona's Medicaid system).
 
The maker of Thomas the Tank Engine, a popular childrens toy, was named in a class action law suit filed in Cook County Circuit Court. The lawsuit claims the toymaker, RC2, is revoking a lifetime warranty.
 
Several class actions have been filed against pet health company Virbac Corporation (Nasdaq: VBACE) and certain of its officers and directors by stockholders who purchased the company's common stock between May 3, 2001, and November 12, 2003. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. The stockholders seek to recover compensatory damages for the loss of value of their stock.
