Ohio State Prisoners' Lawsuit Settles

U.S. District Judge Sandra Beckwith in Cincinnati gave preliminary approval to the five-year plan that also calls for ongoing review of medical policies and procedures. The hearing was set for November 16, 2005.

The lawsuit alleged that Ohio prisoners have a constitutional right to medical and dental care while confined by the state, but the care is inadequate because state officials are deliberately indifferent to their needs.

Under the settlement, the Ohio state prison system will hire about 20 doctors and increase its medical staff by 50 percent under a proposed settlement to a class-action lawsuit brought by inmates alleging inadequate health care.

The settlement agreement calls for hiring about 300 new medical employees over the next four years, plus about 20 physicians the second year, according to tables filed with the proposed agreement last month.

The parties have reached a tentative $5.17 million settlement in an action filed against Station Casinos, Inc., and its subsidiaries, on behalf of all persons who stayed at the Palace Station Hotel & Casino, Boulder Station Hotel & Casino, Texas Station Gambling Hall & Hotel, Sunset Station Hotel & Casino, Santa Fe Station Hotel & Casino, Green Valley Ranch Station Casino, Fiesta Rancho Casino Hotel, Fiesta Henderson Casino Hotel, or the Wild Wild West Gambling Hall & Hotel between April 1, 2001, and June 7, 2004. The action alleged that the company failed to disclose the collection of a $1 charge for telephone usage and an "energy surcharge" of up to $3.50 per night, in violation of state consumer protection statutes. Coupons issued in the settlement must be used within 18 months of the approval of the settlement.
 
A class action has been filed against bank holding company North Country Financial Corporation (Nasdaq: NCFC) and certain of its former officers by stockholders who purchased the company's common stock between November 13, 2000, and April 15, 2003.
 
Several class actions have been filed against construction and facilities services firm EMCOR Group, Inc. (NYSE:EME) and certain of its officers and directors by stockholders who purchased the company's common stock between April 9, 2003, and October 2, 2003. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
Mad Cow Class Action Against Federal Government Obtains Green Light from Quebec Court.
 
The parties have reached a $16 million settlement in a class action filed against energy provider Cleco Corporation on behalf of 264,000 electricity customers across Louisiana. The action alleged that the utility improperly engaged in "round-trip trades" involving power sales from Cleco affiliates to an unnamed trading partner, who then sold the power back to another Cleco affiliate. Persons eligible to take part in the settlement may contact the Louisiana Public Service Commission for more information.
 
A federal judge has ordered Canadian telemarketers World Media Brokers, Express Marketing Services, First TeleGroup Marketing, 637736 Ontario Limited, Cash & Prizes, Inc., and Intermarketing Services, Inc., to pay $19 million in consumer redress to US senior citizens whose money was taken in an illegal Canadian lottery scam perpetrated by these defendants. Persons who lost money to any of these organizations may contact the attorneys who prosecuted the case for more information.
