Defective Tire Rim Lawsuit Settles

Jackson County Circuit Judge Marco Roldan on approved a $33 million dollar settlement, which endeds four years of contentious litigation with Mitsubishi Motors North America Inc., DaimlerChrysler Corp. and DaimlerChrysler Motors Co. LLC of Delaware.

The lawsuits alleged that the the car manufacturers knew that 17-inch rims on four of their models tended to bend under normal driving conditions, causing tire deflation, flats and blowouts. The suits charged that the defendants failed to disclose that information to consumers.

“I think this is an excellent result for our clients and an exceptional one in light of the vigorous defense that was asserted by the defendants,” said the lawyer who spearheaded the litigation. “I think they understood through discovery that there was a significant problem.”

Notice of the nationwide settlement has been mailed to about 390,000 class members — owners or renters of the affected vehicles.

The settlement covers Chrysler Sebring coupes with 17-inch rims, model years 1997-2001; Dodge Avengers with 17-inch rims, model years 1997-2000; and Mitsubishi Eclipses or Eclipse Spyders with 17-inch rims, model years 1997-2002.

Under the settlement, owners who experienced deformed rims during normal use within the vehicles’ three-year warranty period are entitled to receive $205 for each replaced Mitsubishi rim and $275 for each replaced Chrysler rim.

Lessees who replaced deformed rims will be entitled to 75 percent of the cost of replaced rims and 75 percent of penalties incurred for returning vehicles at the end of the lease term because of a deformed rim. The defendants also have agreed to a one-year extended warranty on all new rims purchased.

Other Automotive Cases of Interest

CCC Information Services Inc., a subsidiary of CCC Information Services Group Inc. announced July 13, 2005 it and 15 of its customers signed a settlement agreement with the plaintiffs in various class action suits pending in Madison County, Illinois. The consolidated suits relate to the valuation of vehicles that have been declared total losses by insurers.
 
Vince and Jessica Childers of Hebron, Michigan allege that they, along with at least 59 other customers, purchased used automobiles from Hebron Auto Sales for which the dealership did not have title. The Childerses allege that Hebron Auto Sales kept the money but did not give the car titles to the purchasers.
 
The class has been certified in an action filed against insurance company Farmers Group, Inc., on behalf of all Nevada automobile insurance policyholders of Farmers Insurance Exchange who submitted a first party claim for vehicle theft or property damage, whose vehicle was declared a total loss as valued by CCC Information Services, Inc., or its predecessor Certified Collateral Corporation, and who were paid the valuation amount by Farmers between August 5, 1992, and March 31, 2004. Uninsured/underinsured motorist automobile insurance covers you if you are injured in an accident by a liable party who carries insufficient (or no) liability insurance. The parties have reached a tentative $2 million settlement in an action filed against Nationwide Mutual Fire Insurance Company and related companies on behalf of California policyholders who were sent a selection/rejection form by the company and had their uninsured motorist coverage limits raised unilaterally by the company above $30,000/$60,000 and paid for the coverage between January 1, 1994, and December 31, 2002. Claim forms must be postmarked by October 22, 2003, to be considered valid.
 
A California statewide notice program authorized by California's Sacramento County Superior Court began to issue notices to those who bought, owned or leased 1991-2001 model year Ford Explorers.
 
Sometimes defects in automobiles show up only after months of ownership. A nationwide class action has been filed against automaker DaimlerChrysler AG and its U.S. subsidiary on behalf of owners of 1998 through 2003 model year Dodge Durangos, alleging that the vehicles have defectively-designed upper ball joints that wear prematurely and fail suddenly and violently.
