Transcriptionists File Lawsuit Against MedQuist, Inc.

MedQuist Inc., a leading provider of electronic medical transcription, health information and document management products and services, announced the filing of a lawsuit against the company. The action is allegedly brought on behalf of MedQuist's employee and independent contractor transcriptionists who claim they contracted with the Company to be paid per "AAMT line," but were underpaid due to intentional miscounting of the number of characters and lines transcribed.

The AAMT unit of measure was jointly developed by the American Association of Medical Transcriptionists and other industry groups, but is no longer supported by these groups due to ambiguities in the definition. The named plaintiffs assert claims for breach of contract, unjust enrichment, and request an accounting.

The allegations of the Myers case are substantially similar to those in Hoffman, et al. v. MedQuist, et al., another lawsuit filed in federal court in Georgia. MedQuist is seeking to have the Hoffman action transferred to New Jersey and will request that it be consolidated with the Myers case.

A collective action with apparent national reach has been filed in Alabama against Sanders Oil Company. The action is brought on behalf of all persons employed by Sanders since February 1994, as assistant managers. The action is brought under the federal Fair Labor Standards Act and seeks back pay, statutory and liquidated damages as well as injunctive and declaratory relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered a member of the class. The managers have requested that the court issue notice to all potential claimants.
 
A class action lawsuit has been filed in United States District Court for the Southern District of Florida against cleaning company Hejabo Corporation. The case involves violations of federal labor law. No additional information about the substance of the allegations is available at this time. A class action lawsuit has been filed in the District Court of Connecticut against Mothers Work Inc. for violations of the Fair Labor Standards Act (FLSA) which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. Class members seek damages, costs and attorney's fees.
 
A national collective action has been filed in New Jersey against Provident Bank & Home 1-2-3 Corporation. The action is brought on behalf of all current and former Provident& 1-2-3 loan officers who were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks compensatory, statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
