Bank of America Settles Overtime Class Action

Bank of America Corporation, the second largest American bank, agreed to pay up to $9 million to settle a lawsuit brought by California loan department workers who claimed they had wrongly been denied overtime pay.

The class action suit, filed in U.S. District Court in San Francisco, claimed the bank underpaid account executives, trainees and other workers selling home mortgages and personal loans. California's wage and hour laws required the bank to pay overtime to the loan sellers, who were paid solely through commissions. "The bank didn't meet state or federal minimum wage laws" said the Nevada lawyer who represents the plaintiffs.

Under the settlement, which was filed with the court on September. 16, 2005, the bank will pay as much as $6.68 million to the workers, depending on the number of claims made.

In the wake of Merck’s worldwide recall of the pain medication Vioxx, a growing number and variety of legal actions have been filed against the embattled pharmaceutical giant. This latest is brought under the Federal Employee Retirement Income Security Act (ERISA). Participants in Merck’s employee stock purchase plans say the company’s attempts to cover up the health risks of Vioxx, followed by the eventual recall of the drug, decimated the value of their company stock purchases. The plaintiffs seek damages for the lost value of their stock.
 
A statewide collective action has been filed in Florida against the Carlink Corporation. The action is brought on behalf of all current and former employees of Carlink who were not paid proper overtime wages for all hours worked in excess of 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as injunctive and declaratory relief. As a collective action, all potential claimants must "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential claimants.
