Consumer Class Action Lawsuit Filed Against Palm, Inc.

Three California consumers filed a class action lawsuit on behalf of other customers against Palm, Inc. for selling defective Treo 600 and Treo 650 Smartphones. The case was filed in the Superior Court of California for the County of Santa Clara. In their complaint, the plaintiffs allege that both devices suffer from numerous defects that impair its functionality. These alleged problems include:

•Extremely poor sound quality manifesting itself in a buzzing sound that is heard by the recipients of telephone calls made from the Treo 600.

•Lost calls resulting from the Treo 600 spontaneously resetting itself in the middle of a phone conversation.

•Frequent freezing and crashing in the Treo 650 that requires the use of a hard reset during which all stored information is lost.

According to the New York Times, more than 1.7 million Treos have been sold, and the Treo retails for as much as $600.

"The Treo is advertised as a 'communications lifeline,' but now consumers need a real lifeline to be rescued from Palm," said an attorney representing consumers. "The complaint alleges a wide range of problems with these phones which stem from defects inherent in their design and manufacture and as a result, Palm has made false and misleading statements about the capabilities of the Treo phone."

"We allege in our complaint that Palm has deliberately created a cycle of defective products whereby owners continue to receive defective phones until either they tire of the process or their warranty runs out," said another attorney for the plaintiffs. "Each of the plaintiffs has attempted to have their phones replaced by Palm, instead of new phones they received what appear to be refurbished phones that had been returned to Palm by other customers -- these replacement phones suffered from the same problems that were originally complained about."

"We filed this class action lawsuit only after Palm did not respond to numerous complaint letters regarding Treo defects written by the plaintiffs who asked for a remedy so they would not have to go to court," said another attorney representing purchasers.

Other Consumer Products Cases of Interest

A lawsuit which seeks class action status on behalf of California consumers has been filed against Cost Plus World Market for selling unassembled furniture while failing to disclose in its advertising that the furniture is unassembled.
 
The parties have reached a tentative settlement in a class action filed in the wake of a northern Massachusetts outbreak of Hepatitis A. The case, filed against Delops, Inc., owner of D'Angelo's Sandwich shops, provides for a $200 payment to anyone who had to receive a Hepatitis A immunization after eating food prepared at D'Angelo's Sandwich shop in either Swansea or Seekonk, or at Rudy's Country Store in Swansea, where two employees were infected after eating food from D'Angelo's.
 
Deregulation of the market has done stockholders no favors. Several class actions have been filed against jewelry retailer Friedman's, Inc. Friedman's, Inc. (NYSE: FRM, formerly Nasdaq: FRDM) and certain of its officers and directors by stockholders who purchased the company's common stock between January 26, 2000, through November 17, 2003, and all those who purchased Friedman's shares in its offering on February 11, 2002, for $9.50 per share and its offering on September 18, 2003, for $15.00 per share. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
An Oregon court declined to grant class-action status to a lawsuit against Philip Morris USA brought by a group of Marlboro Lights smokers.
 
The parties have reached a tentative multimillion dollar settlement in an action filed against United Parcel Service, Inc. on behalf persons who bought "excess value" package insurance from UPS going as far back as 1984. The action alleges that UPS overcharged for the insurance in violation of state and federal laws. Customers will be able to apply for UPS vouchers once the settlement is finalized.
