Lawsuit Against Gold Banc Certified by OK Court

The District Court in Kingfisher County, Okla., certified a suit against Gold Banc Corp. Inc. involving Farm Service Agency loans as a class action.

The case was filed on Sept. 10, 2005, and alleges that Gold Banc's Gold Bank subsidiary violated FSA regulations by charging interest rates and fees on FSA-guaranteed agricultural loans that were higher than the interest rates and fees it charged its average agricultural customers.

The court's order certified the case as a class action on behalf of agricultural customers who received FSA-guaranteed loans between Jan. 1, 1999, and Feb. 29, 2004.

Gold Bank ranks No. 4 on The Business Journal's list of Missouri based banks. Gold Banc Corp. has more than $4.4 billion in assets and 38 Gold Bank locations in Kansas, Missouri, Florida and Oklahoma.

A national class action has been filed in Pennsylvania against collection specialists, The Enforcer, Inc. The action is brought on behalf of all U.S. residents who have received allegedly misleading collection letters from The Enforcer since April 30, 2003. The action is brought under the federal Fair Debt Collection Practices Act and seeks actual and statutory damages as well as injunctive and declaratory relief.
 
A class action has been filed against Wells Fargo Home Loans, Inc., an owner and servicer of residential mortgages, for charging hidden fees and costs to homeowners who have filed for protection from creditors under bankruptcy law. The class seeks compensatory damages, attorney’s fees, costs and injunctive relief.
 
A class action has been filed against U.S. Bank and its Indiana collections attorney, Septtimous Taylor, by Indiana residents whose mortgage is held by U.S. Bank and who, at any time since October 10, 2001, were charged foreclosure fees and court costs although foreclosure actions had not been filed in court. Additionally, the action claims that Taylor violated the federal Fair Debt Collection Practices Act. The action seeks restitution and compensatory and statutory damages.
 
The parties have reached a proposed $7.87 million settlement of a class action against Republic Mortgage Insurance Company on behalf of mortgage borrowers whose mortgage was insured by Republic under a certificate that became effective between December 18, 1996, and March 31, 2003. The action claims that the insurance was provided on terms that were very favorable to the mortgage lenders. To recover under the settlement, class members must submit a claim form postmarked no later than September 8, 2003.
 
A statewide class action has been filed in Indiana against the Millikan Law Office and James E. Millikan. The action is brought on behalf of all Indiana residents who have had litigation initiated against them by Millikan in an effort to collect a debt. The action is brought under the federal Fair Labor Standards Act and seeks statutory damages as well as injunctive and declaratory relief.
 
A nationwide class action has been filed against collection agency Gold Key Credit, Inc., on behalf of all US residents who have been wrongly billed overdue charges by the company, its parents, or its subsidiaries. The action alleges that Gold Key has violated the federal Fair Debt Collection Act and the Florida Consumer Collection Practices Act.
