Class Action Suit Forces Palm to Replace Dead PDA's

If you owned a Palm Personal digital assistant model m100, m105, or m125 ("palm PDA") manufactured by PalmOne, Inc. (formerly Palm, Inc.), this information may be important to you.

A proposed settlement has been reached in a lawsuit in which plaintiff claims that: (a) the palm PDAs may be defective in that they sometimes lose data during the process of replacing batteries even when the user follows palm's recommended procedure; and (b) palm allegedly communicated and/or failed to communicate and disclose certain facts and circumstances in connection with data loss.

As part of the settlement, palm has agreed to exchange, at palm's expense, the palm PDA of any owner who: (a) returns the allegedly defective palm PDA; (b) provides a sworn statement that the owner lost data while replacing batteries in accordance with palm's recommended battery replacement procedure; and (c) provides adequate claim documentation (as described in the Claim Form) and proof of membership in the class.

The replacement unit will be a new or refurbished unit of the same or a higher model. palm reserves the right to inspect any palm PDA submitted as part of this settlement. If palm's records or its inspection of the palm PDA show that the cause of data loss during the battery exchange process is due to abuse, mishandling, or misuse of the palm PDA, the claim may be denied.

Claims must be submitted on the Claim Form provided below, and must be submitted within six months after Final Approval (subject to change by the Court). No Settlement Class Member may submit more than one (1) claim with respect to each palm PDA owned by the Settlement Class Member, each claim must relate to a separate palm PDA unit, and only one claim will be accepted for any one PDA. All claims are subject to verification and validation by palm. Claims will not be processed until after Final Approval.

(formerly Nasdaq: FORE) and certain of its officers and directors by stockholders who purchased the company's common stock between July 19, 1996, and April 1, 1997. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. To recover under the settlement, a completed proof of claim postmarked no later than January 14, 2004, must be mailed to the claims administrator.
 
The parties have reached a tentative settlement, apparently valued at $1.8 million, in two related class actions filed against online marketing service LookSmart, Ltd. on behalf of LookSmart customers who purchased a listing from the company between May 13, 1998, and April 9, 2002. The customers allege that they agreed to a contract that included a one-time payment to LookSmart for listing services only to find that the company, in violation of their contracts and California business laws, unilaterally changed their accounts so that they were required to make additional payments. Claim forms must be submitted online on or before November 14, 2003, to be considered valid.
 
A class action has been filed against Equifax Information Services, LLC, a credit reporting agency, by Steven and Melody Millett after Steven’s Social Security number was stolen and used by another individual over the course of 13 years. The Milletts claim that Equifax should have known that the Social Security Number was being used by more than one person and that upon being notified of the error, should have corrected their error. The lawsuit alleges negligent misrepresentation, fraud and failure to comply with the Fair Credit Reporting Act and seeks damages and injunctive relief.
 
Several class action suits have been filed against Dell Inc., the world's largest purveyor of personal computers, and financial partner CIT Bank, claiming that they are systematically deceiving customers who buy Dell products.
 
A class action lawsuit has been filed in Southern District Court of Illinois against the Hewlett-Packard Company. The case involves violations of contract law. No additional information about the substance of the allegations is available at this time.
